Determining salary to calculate benefits for cadres when streamlining
The Ministry of Home Affairs responds to readers' questions about allowances and salaries to calculate the regime for cadres and civil servants when streamlining the apparatus.
Mr. Doan Van Tan (character's name has been changed) learned how to determine time and salary to calculate the policy and regime for cadres when streamlining in Article 5 of Decree 178/2024/ND-CP.
Accordingly, the current monthly salary is the salary of the month immediately preceding retirement, including: Salary level according to rank, office, title, professional title or salary level according to the agreed salary level stated in the labor contract and salary allowances (including: leadership position allowance; seniority allowance beyond the framework; seniority allowance; preferential allowance according to profession; responsibility allowance according to profession; public service allowance; allowance for party work, socio-political organizations; special allowance for armed forces).
"Currently, in addition to salary and position allowances, I receive responsibility allowances for Party Committee members at all levels according to Regulation 169, specifically with a coefficient of 0.3 of the basic salary. So when calculating the regime according to Decree 178/2024, will this allowance be included in the current salary level?" - Mr. Tan wondered.
Regarding Mr. Tan's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Accordingly, Clause 6, Article 5 of Decree No. 178/2024/ND-CP clearly stipulates the allowances to calculate policies and regimes for cadres and civil servants on leave under Decree No. 178/2024/ND-CP, including allowances for responsibilities according to profession, allowances for party work, and socio-political organizations.
However, the responsibility allowance for Party Committee members according to Regulation No. 169-QD/TW dated June 24, 2008 of the Secretariat is not the allowance for Party and socio-political work as prescribed in Decree No. 178/2024/ND-CP.
Therefore, it is not included in the current monthly salary to calculate the policy and regime for cadres and civil servants on leave according to Decree No. 178/2024/ND-CP.
