Is the time spent in the army before becoming a teacher considered seniority allowance?
Reader levyxxx@gmail asks: I joined the army and then discharged from the army to study pedagogy as a teacher. Is the time spent in the army considered for seniority allowance for teachers?
Legal Consulting Department of Lao Dong Newspaper answers:
Clause 1, Article 3, Decree 77/2021/ND-CP stipulates the seniority allowance regime for teachers, stipulating that the time for calculating seniority allowance is determined by the sum of the following times:
a) Time of teaching and education with compulsory social insurance contributions in public educational institutions.
b) Time of teaching and education with compulsory social insurance contributions in non-public educational institutions (for teachers who are teaching and educating in public educational institutions who previously taught and educated in non-public educational institutions).
c) Working hours for which seniority allowance is calculated, including: working hours ranked according to one of the ranks or titles of customs, court, procuracy, audit, inspection, civil judgment enforcement, forestry, national reserve, party inspection specialties; working hours for which seniority allowance is calculated in the army, police, cryptography and working hours for which seniority is calculated in other industries and professions (if any).
d) The time of military service according to law that is being considered for seniority allowance before military service.
Because you joined the army and then discharged from the army to study pedagogy and then become a teacher, the time spent in the army is not counted for seniority allowance.
