Proposal to keep the personnel work process at the National Assembly session

On April 23, the National Assembly Standing Committee gave its opinion on reporting on a number of issues on the drafting of a Resolution amending and supplementing a number of articles of the National Assembly Session Regulations.

Secretary General of the National Assembly, Head of the National Assembly Office Le Quang Tung said that through synthesis, all agencies agreed with the necessity, scope of amendments and supplements and most of the contents of the draft Resolution proposed by the Drafting Committee, including a number of major issues:

There are no strict regulations in the regulations of the National Assembly session on the presentation of the appraisal report; accordingly, the presentation or failure to present the appraisal report (only sending the appraisal report to National Assembly deputies) for each content will be implemented in accordance with the provisions of the Law on Promulgation of Documents regulating relevant laws, laws, and resolutions or will be specifically considered and decided by the National Assembly to ensure the safe and effective use of time.

In addition, regulations related to the responsibility to explain, absorb, and revise draft laws and legal resolutions; regulations on decisions on the establishment and dissolution of agencies; decisions on the establishment, dissolution, merger, division of administrative units, adjustment of boundaries and renaming of provincial-level administrative units, special administrative-economic units... to ensure compliance with new regulations of the Law on Organization of the National Assembly, the Law on Promulgation of Legal Documents, the Law on Organization of Local Government...

According to the report, some other contents that agencies have opinions on are the number of regular sessions and the way to number the sessions.

There are opinions suggesting that the National Assembly should hold at least 2 regular sessions per year; it is not advisable to distinguish between regular sessions and extraordinary sessions/unusual sessions.

The Drafting Committee found that Clause 2, Article 83 of the 2013 Constitution and Clause 2, Article 90 of the current Law on the Organization of the National Assembly stipulate: "The National Assembly will hold a regular meeting every two terms".

Therefore, to ensure consistency, it is recommended to keep the expression of the number of regular sessions as in the draft. However, this is also a reasonable opinion in the innovation process and the trend of organizing many sessions, so the Drafting Committee would like to acknowledge and continue research.

Regarding the discussion at the plenary session of the National Assembly. There are opinions suggesting keeping the time for delegates to give their first speech at no more than 7 minutes, and their second speech at no more than 3 minutes to ensure that delegates have time to fully participate in giving opinions, especially on complex and in-depth topics.

Regarding this issue, the Drafting Committee proposes to maintain the regulation on proposing that the National Assembly decide to shorten the speaking time of each delegate at the plenary session of the National Assembly to create initiative and flexibility in the session management process, ensuring the economical and efficient use of time at the plenary sessions of the National Assembly.

Regarding the personnel work process at the meeting. There were opinions suggesting shortening the procedures at the session related to the election and approval of State positions; dismissal, removal, approval of proposals for dismissal, removal, removal from duties of National Assembly deputies... to avoid formality.

The Drafting Committee finds that the consideration and decision on personnel issues is an important authority of the National Assembly, which must be ensured with caution, strictness and thoroughness.

Therefore, the Drafting Committee would like to keep the contents related to the personnel work process at the session as in the current National Assembly Session Regulations.
