Marriage registration must use both electronic and paper civil status books
The draft revised Law on Civil Status assigns the Commune People's Committee to register all civil status events and information; marriage registration using electronic books and paper books.
On the morning of April 9, continuing the First Session, the National Assembly listened to Minister of Justice Hoang Thanh Tung, authorized by the Prime Minister, present the submission of the draft Law on Civil Status Registration (amended).
Regarding the authority to register civil status, Minister Hoang Thanh Tung said that the draft law assigns commune-level People's Committees to register all civil status events and information; civil status is registered regardless of place of residence, regardless of administrative boundaries.
The draft law only stipulates the authority, subjects, and scope of each civil status registration procedure; specific regulations on the composition of dossiers, deadlines, order, and procedures for civil status registration - are contents that are prone to fluctuation, the draft law assigns the Government to detail.
The applicant has the right to choose to submit dossiers and receive civil status registration results online or directly or via postal services; the draft law assigns the Government to detail the entire online process for most civil status procedures (except for marriage registration procedures where guardians must be present at the civil status registration agency...).
Regarding civil status books, electronic data is mainly used; only marriage registration uses both electronic books and paper books (in accordance with the characteristics and traditions that both men and women must be present to express their willingness and sign marriage registration books and marriage certificates).
Civil status documents include birth certificates, marriage certificates, death certificates and civil status confirmation documents. The Government will specifically regulate the issuance of civil status documents (electronic version, paper version, original version, copy).
The draft law assigns the Government to direct the review and training of civil status nghiệp vụ, consolidate the contingent of civil servants performing civil status work; stipulate conditions and standards for civil status workers to ensure the performance of tasks and powers assigned in the law.
The draft law supplements regulations on the rights and obligations of registering civil status of people of Vietnamese origin who have not yet determined nationality living in Vietnam; supplements regulations to ensure the right to register birth certificates for children born in Vietnam or living stably on Vietnamese territory.
Supplementing regulations that the civil status registration agency is responsible for proactively exploiting and searching information in the relevant database, only requiring people to submit and present documents if information cannot be exploited or the exploited information is incomplete or inaccurate.
Supplementing regulations affirming the legal value of civil status papers, civil status information, electronic civil status data, determining that electronic civil status data is as valuable as paper civil status papers when carrying out administrative procedures and other transactions.
Supplementing the authority to register for supervision of guardianship, terminating supervision of guardianship related to the management of assets of the person being guardianized regardless of the place of residence of the individual.

Appraising the draft law, Chairman of the National Assembly's Law and Justice Committee Phan Chi Hieu said that the majority of opinions in the Law and Justice Committee basically agree with the provisions of the draft law because strengthening online full-service, non-administrative-territory civil status registration is suitable for the current context.
Currently, the Civil Status Database has been built and is continuing to be completed to implement the requirements of comprehensive innovation in resolving administrative procedures, providing public services regardless of administrative boundaries, improving the quality of online public services for people, towards providing full online public services, personalized and based on data.
