Lao Dong Newspaper has just reported on the case of Mrs. Nguyen Thi Ngat (81 years old, in Hanoi) who has not received social insurance benefits for 5 years after suffering a stroke in 2021, completely losing her cognitive ability.
Immediately after receiving the reflection from Lao Dong Newspaper, the leaders of Hanoi City Social Insurance directed Hai Ba Trung grassroots Social Insurance and related units to urgently review information, verify and report on the case of Ms. Nguyen Thi Ngat.
According to the report of the Hai Ba Trung grassroots social insurance agency, Ms. Ngat is currently enjoying 2 regimes: the 613 allowance regime and the monthly survivor's allowance regime according to the cash payment method organized by the Post Office agency in charge of payment.
Data from the salary table list for July 2026 shows the amount of money not received according to each regime and the salary for July 2026 of Ms. Nguyen Thi Ngat specifically as follows: The amount of allowance 613 is 119,342,400 VND. Of which, the amount of late payment from July 2021 - June 2026 is 116,328,600 VND; The salary for July 2026 is 3,013,800 VND.
For the monthly survivor's allowance regime, the amount is 58,025,000 VND, of which the amount of late payment from July 2021 - June 2026 is 56,760,000 VND; The salary for July 2026 is 1,265,000 VND.
Thus, the total amount Ms. Ngat received in this payment is 177,367,400 VND.
According to the leader of Hanoi City Social Insurance, on the morning of July 1st, representatives of Hai Ba Trung grassroots Social Insurance agency, the Payment Support Organization and representatives of Bach Mai Ward People's Committee went to Ms. Nguyen Thi Ngat's house to hand over the entire amount of social insurance allowance not yet received to the family representative, who is Ms. Ngat's daughter.
At the same time, Hanoi City Social Insurance has also requested social insurance agencies to closely coordinate with the Payment Support Organization (Post Office), Commune and Ward People's Committees, and Public Administrative Service Centers to directly review the number of people receiving pensions and social insurance allowances who have not exercised authorization or are late in receiving them to support completing procedures and immediately resolve unfortunate cases arising during the payment process, ensuring the best rights of the people.
Proposing competent authorities to soon issue guiding circulars or sub-law documents, creating favorable conditions for people.
Regarding this case, in an exchange with Lao Dong reporters, Dr., Lawyer Dang Van Cuong - Head of Chinh Phap Law Office (Hanoi Bar Association) said: The case of Mrs. Nguyen Thi Ngat simultaneously reflects two issues: Inadequacies in implementation organization and legal loopholes.
Receiving monthly allowances and pensions is very different from civil transactions of great value such as buying and selling houses and land, borrowing money or mortgaging assets.
In this case, the recipient only receives the periodic amount to serve treatment, care and ensure living for the beneficiaries themselves.
Therefore, the law can completely design a more flexible mechanism while still controlling risks.
According to the lawyer, it is possible to study regulations in the direction of only needing confirmation from a medical facility about the beneficiary's inability to perceive; documents proving family relationships; minutes of agreement of family members or commitments of the recipient on behalf of the person about using the money for the right purpose. At the same time, the social insurance agency implements a post-inspection and examination mechanism to promptly handle if acts of taking advantage and appropriating property are detected.
If the person assigned to receive it takes advantage of it to appropriate the beneficiary's money, the law has sufficient civil, administrative and criminal sanctions to handle it. Therefore, it is entirely possible to build a simpler procedure while still ensuring strict control," he said.
The lawyer also proposed that competent authorities soon issue guiding circulars or sub-law documents to remove difficulties for the elderly, people with stroke, dementia or complete loss of cognitive ability when carrying out procedures to receive allowances and pensions.
