From October 2026, public lawyers will receive additional monthly support

Article 22, Decree 364/2025/ND-CP detailing a number of articles and measures to implement Resolution No. 24/2026/QH16 of the National Assembly on piloting the institution of public lawyers (effective from October 1, 2026), stipulates the regime and policies for public lawyers as follows:

1. In addition to salary, public lawyers working in state-owned enterprises are entitled to monthly support; the monthly support level is agreed upon in the labor contract with the state-owned enterprise.

2. Monthly support is paid by the agency or business managed by public lawyers on the same salary period.

3. In addition to monthly support and case-by-case training, public lawyers also enjoy regimes and policies according to the provisions of Article 10 of the Resolution.

Article 10, Resolution No. 24/2026/QH16 of the National Assembly stipulates the regime and policies for public lawyers as follows:

1. In addition to the salary regime according to the provisions of law, public lawyers are entitled to monthly support and other regimes and policies similar to those for cadres, civil servants, public employees, and officers of the armed forces who have positions in law-making and legal affairs according to the provisions of Resolution No. 197/2025/QH15 of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law-making and law enforcement. In case public lawyers simultaneously enjoy many monthly support policies, they are only entitled to the highest support policy.

2. Public lawyers when participating in resolving legal cases are entitled to allowances according to cases. The allowance level paid for 01 working session is 0.5 times the base salary.

3. Monthly support and seasonal and work allowance specified in Clauses 1 and 2 of this Article are not used to calculate social insurance contributions and benefits. Income from the work of public lawyers as prescribed in this Resolution is exempt from personal income tax and other financial obligations to the State.

4. Public lawyers are paid by the State fees related to joining and maintaining the membership of the lawyer's socio-professional organization, and are guaranteed equipment and working facilities to perform assigned tasks.

5. The Government shall specifically stipulate the application of Clause 1 of this Article to public lawyers who work in state-owned enterprises; detail regulations on regimes, policies, and funds to ensure the operation of public lawyers.

Thus, from October 1, 2026, public lawyers are entitled to regimes and policies according to the above regulations.
