Clause 1, Article 15, Decree 363/2026/ND-CP stipulating penalties for administrative violations in the field of data (effective from November 11, 2016) stipulates violations of regulations on fines from 20 million VND to 40 million VND for one of the following acts:
a) Failure to carry out data verification and authentication when requested legally by competent organizations and individuals;
b) Verifying and authenticating data when not authorized, not assigned tasks or exceeding the assigned scope.
Clause 2, Article 6, Decree 363/2026/ND-CP stipulates that the fine level specified in Chapter II of this Decree is the fine level applied to administrative violations of individuals, except for cases specified in point b, clause 1, Article 8; Article 9; Article 10; clause 2, Article 13 and clause 4, Article 16 of this Decree is the fine level for organizations. The fine level for organizations is equal to 2 times the fine level for individuals.
Thus, from November 11, 26, the act of not performing data confirmation and authentication when requested legally by a competent organization or individual may be fined from 20 million VND to 40 million VND for individuals and 40 million VND to 80 million VND for organizations.
