Legal Consulting Department of Lao Dong Newspaper answers:
Article 11, Decree 335/2026/ND-CP (effective from October 5, 2026) stipulates funeral expense support as follows:
1. Subjects supporting funeral expenses upon death are as follows:
a) Subjects specified in Article 5 of this Decree who are receiving monthly social allowances or subjects who have a Declaration requesting to enjoy regimes and policies and are eligible to enjoy, but the Chairman of the Commune People's Committee has not issued a decision on monthly social allowances;
b) Children of poor single parents raising children specified in Clause 4, Article 5 of this Decree;
c) People from 75 years old who are receiving monthly social insurance survivor's allowance, other monthly allowances;
d) People from 70 to under 75 years old belonging to poor and near-poor households who are receiving monthly social insurance survivor's allowance.
Thus, from October 5, 2026, elderly people in the above case will be entitled to funeral support.
