Ministry of Construction answers about the cost of relocating technical infrastructure when site clearance
The Ministry of Construction's agency has just given answers on regulations on relocation costs and technical infrastructure restoration in site clearance work.
On the Ministry of Construction's Information Portal, reader L.L wondered:
According to Decree No. 35/2023/ND-CP, the relocation cost to return the technical infrastructure is determined to be the site clearance compensation cost.
However, is there any document stipulating that if the cost of relocating this technical infrastructure exceeds a certain level, an economic - technical report must be prepared as a normal project?

Answering this question, after research, the Department of Economics - Construction Investment Management (Ministry of Construction) has the following opinion:
The cost of relocation and return of technical infrastructure belonging to compensation, support and resettlement costs is regulated in Article 10 of Decree No. 35/2023/ND-CP dated June 20, 2023 of the Government on amending and supplementing a number of articles of decrees in the field of state management of the Ministry of Construction.
Compensation, support and resettlement costs are guided in Decree No. 88/2024/ND-CP dated July 15, 2024, stipulating compensation, support, and resettlement when the state recovers land.
