Agree not to organize the Investigation Agency of the Supreme People's Procuracy
The Government agreed not to organize the Investigation Agency of the Supreme People's Procuracy in accordance with the provisions of the Constitution.
The Government has just issued Resolution No. 88/NQ-CP dated April 15, 2025 on the thematic session on law-making in April 2025.
For the draft Penal Code (amended), the Government basically agreed with the content of the draft Penal Code (amended) submitted by the Ministry of Public Security in Submission No. 164/TTr-BCA dated April 10, 2025.
The Ministry of Public Security shall preside over and coordinate with relevant ministries and agencies to study and carefully consider the scope of amendments and supplements; select inadequate and very urgent issues of the current Penal Code to have an optimal, appropriate and effective handling plan to immediately amend and supplement a number of articles under the direction of the Politburo, meeting the requirements of the fight against crime in the new situation.
Review, research, and ensure the amendment and supplementation of the non-criminal nature of economic and civil relations. More carefully assess the advantages, disadvantages, and impacts of expanding the scope of criminal liability of commercial entities and raising the prison sentence to 30 years and adding a life imprisonment without reducing the sentence.
The Ministry of Public Security is responsible for the content of receiving and completing the draft Penal Code (amended); proactively reporting and explaining during the review process, receiving opinions from the National Assembly Standing Committee on the draft Code.
On the basis of receiving and completing the draft Penal Code (amended), the Minister of Public Security is authorized by the Prime Minister to sign the Government's Submission on the draft Penal Code (amended) on behalf of the Government and submit it to the National Assembly.
Regarding the draft Law on the Organization of Criminal Investigation Agencies (amended), combined with amending and supplementing a number of articles of the Law on Enforcement of Criminal Judgments and amending and supplementing a number of articles of the Law on Prevention and Combat of Human Trafficking, the Government assigned the Ministry of Public Security to study and consider the scope of amendments and supplements.
Focus on amending and supplementing a number of articles of the current Law on Organization of Criminal Investigation Agencies, ensuring compliance with the Party's viewpoints and instructions and the requirements for reorganizing the apparatus according to the provisions of Resolution No. 190/2025/QH15 on handling a number of issues related to the reorganization of the state apparatus.
Assign the Ministry of Public Security to carefully review the resolutions and conclusions of the Politburo and the Central Committee related to the Investigation Agency of the Supreme People's Procuracy.
The non-organization of the Investigation Agency of the Supreme People's Procuracy is not contrary to the resolutions of the Politburo and the Central Committee, the Government agrees with not organizing the Investigation Agency of the Supreme People's Procuracy in accordance with the provisions of the Constitution.
In case the National Assembly has another opinion, the Government Party Committee shall agree with the National Assembly Party Committee to report to the competent authority for opinions.
