New regulations on summer vacation for teachers and staff at schools
The working regime and summer vacation of teachers and staff are something that many people are interested in.
The Ministry of Education and Training (MOET) has just issued Circular No. 05/2025/TT-BGDDT (abbreviated as Circular 05), effective from April 22, 2025. This Circular stipulates the working regime for general education teachers and teachers of pre-university schools.
Circular 05 officially replaces Circular No. 28/2009/TT-BGDDT dated October 21, 2009 - this is a document that has been applied for the past 16 years. One of the notable new points of this Circular is the addition of regulations on annual leave for principals and vice principals of general schools.
Accordingly, principals and vice principals will have summer vacation like teachers, with leave flexible throughout the school year and summer vacation. However, to ensure the school's stable operation, the leave schedule of managers must be reported and agreed upon with the management agency, avoiding the situation where the entire board of directors leave at the same time.
For teachers, the annual summer vacation is 2 months, including leave according to the provisions of the 2019 Labor Code. During this time, teachers are still entitled to full salary and allowances (if any).
Comparison according to the latest Circular of the Ministry of Education and Training does not stipulate summer vacation regime for school staff. School staff are identified as educational civil servants, and their working regime will comply with the administrative hours and regulations on working and resting hours according to the Labor Code.
In case there is a need for summer vacation, school staff must have the consent of the principal and the leave must comply with the provisions of Articles 113 and 114 of this Code.
According to the provisions of the Labor Code, employees who have worked for a job for 12 months at an employer will have annual leave and receive full salary. Specifically:
12 working days for work under normal conditions
14 days for underage workers, people with disabilities or working in harsh, toxic, dangerous environments
16 days for people working in particularly arduous, toxic, or dangerous jobs or jobs.
In addition, for every 5 consecutive years of work, employees are entitled to an additional day off every year.
Accordingly, school staff will not have long summer vacation like teachers, but there will still be an annual leave regime according to the provisions of current labor law.
