Deadline for submitting to the National Assembly draft revised Law on Inspection
The Government Inspector General is assigned to sign the Government's submission on the draft Law on Inspection (amended) to the National Assembly on behalf of the Government no later than April 15.
On April 14, the Government Office announced that the Government had just issued Resolution No. 82/NQ-CP on the draft Law on Inspection (amended).
The Resolution clearly states that the Government highly appreciates the Government Inspectorate for actively and proactively coordinating with relevant ministries and branches to urgently develop and submit to the Government the draft Law on Inspection (amended) to ensure the content and progress according to the requirements of the Politburo, the Secretariat and the Prime Minister.
Relevant ministries and agencies have actively contributed their opinions and completed the draft Law on Inspection (amended) with a high sense of responsibility.
The draft Law on Inspection (amended) has been institutionally correct in the policies and instructions of the Politburo and the Secretariat in Conclusion No. 127-KL/TW dated February 28, 2025 on implementing research and proposing to continue to reorganize the apparatus of the political system and Conclusion No. 134-KL/TW dated March 28, 2025 on the Project to reorganize the inspection agency system to be streamlined, compact, strong, efficient, effective and efficient.
The Government basically agreed on the content of the draft Law on Inspection (amended) submitted by the Government Inspectorate to the Government in Submission No. 518/TTr-TTCP dated March 28, 2025.
The Government assigns the Government Inspectorate to preside over and coordinate with relevant ministries and agencies to study and absorb the maximum opinions of Government members, urgently completing the draft Law on Inspection (amended).
Assign the Government Inspector General to authorise the Prime Minister, on behalf of the Government, to sign the Government's submission on the draft Law on Inspection (amended) to the National Assembly no later than April 15, 2025.
Previously, the draft revised Law on Inspection, which the Government Inspectorate solicited public opinions, proposed to stipulate that the inspection agency includes:
1. Government Inspectorate.
2. The Inspectorate of provinces and centrally run cities (hereinafter referred to as the Provincial Inspectorate).
3. Inspection agencies in the People's Army, People's Public Security, State Bank of Vietnam, and the Inspectorate.
4. The inspection agency was established under international treaties to which the Socialist Republic of Vietnam is a member, including:
- Inspectorate of the Department of radiation and Nuclear Safety;
- Inspectorate of the Vietnam Maritime and Waterway Administration;
- Inspectorate of the Civil Aviation Authority of Vietnam;
- Inspectorate of the State Securities Commission.
Regarding transitional regulations, the draft law clearly states that inspections with inspection decisions issued before the effective date of this Law will continue to be implemented according to the provisions of the Inspection Law No. 11/2022/QH15 and Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly regulating the handling of a number of issues related to the arrangement of the state apparatus.
In case the law, resolution of the National Assembly, or resolution of the National Assembly Standing Committee regulating the organization and operation of inspection are not in accordance with the provisions of this Law, they shall be adjusted to be consistent with the provisions of this Law within 2 years from the effective date of this Law; during the period not yet amended or supplemented, they shall be implemented according to the provisions of this Law.
