Treatment for military officers who wish to retire early
Policies and regimes for officers and professional soldiers who wish to retire early are stated in Article 8, Circular 19/2025/TT-BQP of the Ministry of National Defense.
The Ministry of National Defense has just issued Circular No. 19/2025/TT-BQP guiding the implementation of policies and regimes for subjects under the management of the Ministry of National Defense in implementing the organizational arrangement of the apparatus.
Article 8 states the conditions and calculation of policies for cases that are not old enough to be re-elected or reappointed; meet the age requirement for re-election, reappointment or are participating in Party committees in Party committees that must end their activities but wish to retire early.
Regarding the conditions for enjoying policies and regimes:
Officers, professional soldiers, defense officials, and people working in key positions under the Government backlog receive salaries as for soldiers specified in Clause 1 and Clause 4, Article 2 of this Circular holding positions and titles under the structure of participating in the Party Committee, full-time members of the Inspection Committee at the same level but not meeting the age requirements for re-election or reappointment to the new term.
At the same time, the working time from the date of congress to the expiration of the highest age or the retirement age according to the instructions in Point a, Point b, Clause 5, Article 5 of this Circular is no more than 6 months.
Subjects at Point a of this Clause who meet the age requirement for re-election or reappointment to the new term of office for the Party Committee have a working period from 30 months to 60 months from the date of holding the congress; in special cases with 12 months to less than 30 months, the highest service age expires or reach the retirement age according to the instructions at Point a, Point b, Clause 5, Article 5 of this Circular, but because of the arrangement of personnel at the Party Committee level, they wish to retire and are approved by the competent authority.
Subjects specified in Clause 1, 2, 4 and Clause 5, Article 2 of this Circular who are participating in Party committees in Party committees (5-year term) must end their activities and perfect the apparatus with 5 years (60 months) or less before reaching the highest service age or reach the retirement age according to the instructions in Point a, Point b, Clause 5, Article 5 of this Circular, and wish to retire early, to facilitate the arrangement of Party committee personnel in the Party congresses at all levels towards the 14th National Congress of the Party and be approved by competent authorities.
Regarding the calculation of the regime, the subjects specified in Clause 1 of this Article who are eligible for early retirement are entitled to the regimes specified in Clause 8, Article 1 of Decree No. 67/2025/ND-CP.
In particular, the subsidy regime for the number of years of early retirement and the subsidy regime for the working period with compulsory social insurance contributions for those who are 2 years old or 5 years old until the age limit as instructed in Point a, Point b, Clause 5, Article 5 of this Circular are implemented according to the instructions in Point b, Point c, Clause 1, Article 6 of this Circular.
Regarding one-time pension benefits for the number of months of early retirement, the following provisions are made:
One-time pension subsidy = Current monthly salary according to the instructions in Clause 3, Article 4 of this Circular x 1.0 x Number of months of early retirement according to the instructions in Clause 1, Article 5 of this Circular.
Circular No. 19/2025/TT-BQP officially takes effect from April 11, 2025.
