The authority to handle traffic violations of the commune police chief according to the latest regulations

The Government has just issued Decree No. 238/2026/ND-CP amending and supplementing a number of articles of Decree No. 168/2024/ND-CR stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring points for driver's licenses.

According to Article 14 of Decree No. 238/2026/ND-CP, amending and supplementing Article 43 of Decree No. 168/2024/ND-CР on the sanctioning authority of the people's police as follows:

1. People's Police soldiers on duty have the right to:

a) Warning;

b) A fine of up to 7.5 million VND:

c) Confiscate exhibits and means of administrative violations with a value not exceeding 15 million VND.

2. Heads of mobile police units at the company level have the power to:

a) Warning;

b) A fine of up to 15 million VND;

c) Confiscate exhibits and means of administrative violations with a value not exceeding 30 million VND.

d) Applying remedial measures specified in Clause 3, Article 3 (except point c, Clause 3, Article 3) of this Decree.

3. Head of Police Station, Head of Battalion-level Mobile Police Unit, Head of Station, Team Leader has the power to:

a) Warning;

b) A fine of up to 22.5 million VND;

c) Revocation of the right to use licenses, professional certificates for a limited term or suspension of operations for a limited term

d) Confiscation of exhibits and means of administrative violations with a value not exceeding 45 million VND:

d) Applying remedial measures specified in Clause 3, Article 3 (except for point c, Clause 3, Article 3) of this Decree.

4. The Head of the Commune-level Police has the power:

a) Warning;

b) A fine of up to 37.5 million VND;

c) Revocation of the right to use licenses, professional certificates for a limited term or suspension of operations for a limited term;

d) Confiscation of exhibits and means of administrative violation,

d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.

5. Heads of professional departments under the Traffic Police Department include: Head of the Department of Guidance, Propaganda, Investigation, and Resolution of Traffic Accidents, Head of the Department of Guidance, Registration and Inspection of Vehicles, Head of the Department of Guidance, Training, Testing, and Management of Licenses of Vehicle Drivers, Head of the Department of Guidance for Road and Railway Traffic Patrol and Control, Head of the Department of Guidance for Traffic Control and Escort, Head of the Department of Management, Exploitation, Processing, Data Operation and Digital Transformation Heads of professional departments under the Department of Administrative Management of Social Order include: Head of the Department of Guidance, Management of Weapons, Explosives, Supporting Tools and Firecrackers, Head of the Department of Guidance, Management of Investment and Business Professions with Conditions on Security, Order and Seals, Director of the National Population Data Center; Heads of Mobile Police units at regimental level; Provincial Police Departments include: Head of the Department of Administrative Management of Social Order, Head of the Traffic Police Department, Head of the

a) Warning

b) A fine of up to 60 million VND;

c) Revocation of the right to use licenses, professional certificates for a limited term or suspension of operations for a limited term;

d) Confiscation of exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.

6. Provincial-level Police Directors have the power to:

a) Warning

b) A fine of up to 75 million VND;

c) Revocation of the right to use licenses, professional certificates for a limited term or suspension of operations for a limited term;

d) Confiscation of exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.

7. Director of the Traffic Police Department, Director of the Police Department for Administrative Management of Social Order, Commander of the Mobile Police have the power to:

a) Warning;

b) A fine of up to 75 million VND;

c) Revocation of the right to use licenses, professional certificates for a limited term or suspension of operations for a limited term;

d) Confiscation of exhibits and means of administrative violations;

d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
