Conditions for enjoying regional allowances for sick soldiers receiving pensions

Reader T.K. A said that her uncle is a sick soldier with a 61% reduction in working capacity, and is also receiving a pension and living in a commune in the ethnic minority and mountainous areas of region I, where the regional allowance coefficient of 0.1 is applied.

According to reports, from January 2026, wounded soldiers and sick soldiers living in the commune will receive an additional 234,000 VND per month in regional allowances. However, Ms. K.A's uncle is not paid this allowance on the grounds that he is receiving a pension.

Meanwhile, the pension payment agency also announced that her uncle is not eligible for the regional allowance of 234,000 VND.

Ms. K.A asked, based on Joint Circular No. 11/2005/TTLT-BNV-BLĐTBXH-BTC-UBDT, is her uncle eligible for regional allowance or not? If eligible, which agency pays this allowance and which agency the family needs to contact for consideration and settlement?

Regarding this issue, the Ministry of Home Affairs replied as follows: On January 5, 2005, the Minister of Home Affairs, the Minister of Labor, Invalids and Social Affairs, the Minister of Finance and the Minister, Chairman of the Committee for Ethnic Minorities signed and issued Joint Circular No. 05/2005/TTLT-BNV-BLĐTBXH-BTC-UBDT guiding the implementation of regional allowance regimes (amended and supplemented in Circular No. 15/2026/TT-BNV dated June 30, 2026).

In which, Section I of Joint Circular No. 05/2005/TTLT-BNV-BLĐTBXH-BTC-UBDT has stipulated the scope and subjects of application, Clause 3 Section II stipulates the method of calculating regional allowance payment and Clause 4 Section II stipulates the source of funding for regional allowance payment.

Accordingly, Ms. T.K. A is requested to contact the provincial/city social insurance agency for guidance and implementation to ensure regimes and policies according to current regulations.
