Cases where it is not required to submit documents proving the conditions for residence registration

Circular 116/2026/TT-BCA dated June 29, 2026 of the Ministry of Public Security detailing a number of articles and measures to implement the Law on Residence, effective from July 1, 2026.

In which, Article 3 has contents regulating the receipt and resolution of dossiers and notification of the results of settlement of residence procedures.

The receipt of residence registration dossiers is carried out in the form of directly at the residence registration agency or online through the National Public Service Portal, the National Identification Application (VNeID).

In case of submitting applications directly at the residence registration agency, citizens shall provide information including: full name, middle name and birth certificate, date, month, year of birth, personal identification number, place of residence and information on residence registration conditions.

Receiving officials perform lookup and exploitation of citizen information in the National Population Database and related databases and information systems to create residence registration dossiers.

After completing the application submission, the person requesting residence registration pays the residence registration fee according to regulations. Each dossier is issued 1 administrative procedure dossier code for people to monitor and look up the progress of dossier resolution.

In case of online residence registration, citizens declare information according to the pre-provided electronic form and information and documents on residence registration conditions; pay fees through the online payment function. After completing the dossier submission, each dossier is issued 1 administrative procedure dossier code to monitor and look up the progress of dossier resolution.

In case citizens do not carry out residence procedures themselves, they are authorized to authorize others to carry out residence procedures, except in cases where the guardian or representative performs residence procedures for the guardian or representative, they are not authorized.

In case the information and documents proving the conditions for residence registration have been shared and exploited from a database, information system or national identification application (VNeID), the residence registration agency is not allowed to require citizens to submit or present those documents to resolve residence registration.

In case information cannot be exploited in the database, information system or national identification application (VNeID), the residence registration agency is responsible for checking and verifying to resolve residence procedures. Citizens are responsible for presenting original papers and documents proving the declared information for the residence registration agency to check, compare and record accuracy in minutes when carrying out verification.

In case citizens provide papers and documents in the application for residence registration, the scanned copy or photocopy of papers made by electronic devices from validly issued papers that are still valid must ensure clearness, completeness, and integrity of the content; have been consularly legalized, translated into Vietnamese according to regulations if they are papers issued by a foreign competent authority, except for cases of consular legalization exemption.

Notices of the results of settlement of residence procedures are made in the form of paper documents, electronic documents, SMS messages, and notifications through the national identification application (VNeID).

The residence registration agency has the right to refuse to resolve residence procedures and not refund fees for cases where fees have been paid if it detects that citizens' declarations are not true or citizens' papers and documents provided to carry out residence procedures have been erased, corrected, or forged.
