Point a, Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces (amended by Point a, Clause 9, Article 10 of the Law amending and supplementing a number of articles of 11 Laws on military and national defense No. 98/2025/QH15) stipulates:

The commander-in-chief is a civil servant, a member of the Commune-level People's Committee, a reserve officer; in emergency situations of national defense, war situations, they are called to serve in active duty according to the provisions of the Law on Officers of the Vietnam People's Army and continue to hold the position of Commander-in-chief of the Commune-level Military Command".

At the same time, Point b Clause 1 Article 2 of the 2024 Law on Social Insurance stipulates that civil servants are subjects participating in compulsory social insurance.

Based on the 2024 Law on Social Insurance, civil servants who retire with a compulsory social insurance contribution period of 15 years or more and reach the retirement age as prescribed in Article 169 of the Labor Code are entitled to a pension with the pension level as prescribed in Point b Clause 1 Article 66 of the 2024 Law on Social Insurance:

For male workers, it is equal to 45% of the average salary used as the basis for social insurance contributions specified in Article 72 of this Law, corresponding to 20 years of social insurance contributions, then for each additional year of contribution, an additional 2% is calculated, the maximum level is 75%.

For civil servants retiring early due to reduced working capacity as prescribed in Article 65 of the 2024 Law on Social Insurance, for each year of early retirement, the pension level is reduced by 2%.

If the pre-retirement period is less than 06 months, the percentage of pension benefits is not reduced, from 06 months to less than 12 months, it is reduced by 1%.

Based on the provisions of Article 13 of Decree 158/2025/ND-CP, the monthly pension level for compulsory social insurance contributors is calculated according to the following formula:

Monthly pension level = (Monthly pension benefit rate) x (Average monthly salary level for social insurance contributions).

Based on the above regulations, the Commander of the Commune-level Military Command is male, pays social insurance for 25 years, the average monthly salary for social insurance contributions is 5,200,000 VND, is eligible to retire and receive a pension in August 2026, the monthly pension level is determined as follows:

+ 20 years of social insurance contribution corresponding to 45% of the average salary level used as the basis for social insurance contribution.

+ The remaining 5 years of social insurance contribution correspond to 10% of the average salary level used as the basis for social insurance contributions.

First 20 years: Calculated at 45%.

5 years remaining: 5 x 2% = 10%.

Total pension benefit rate: 45% + 10% = 55%.

The monthly pension level of the male Commander of the Military Command at the commune level is 55% of the average salary level used as the basis for social insurance contributions, corresponding to 55% x 5,200,000 VND = 2,860,000 VND.

In case the male Commander of the Military Command at the commune level retires early due to reduced working capacity, for each year of early retirement, the pension level is reduced by 2%.

If the early retirement period is less than 6 months, the percentage of pension benefits is not reduced, from 6 months to less than 12 months, it is reduced by 1%.
