Retirement age of the Commander of the Military Command of commune level in 2026

Point a, Clause 1, Article 20 of the 2019 Law on Militia and Self-Defense Forces (amended by Point a, Clause 9, Article 10 of the Law amending and supplementing a number of articles of 11 Laws on military and national defense No. 98/2025/QH15) stipulates:

The commander-in-chief is a civil servant, a member of the Commune-level People's Committee, a reserve officer; in emergency situations of national defense, war situations, they are called to serve in active duty according to the provisions of the Law on Officers of the Vietnam People's Army and continue to hold the position of Commander-in-chief of the Commune-level Military Command".

Clause 2, Article 32 of the 2025 Law on Cadres and Civil Servants stipulates: "Civil servants are entitled to retirement according to the provisions of the Labor Code, except as prescribed by the competent authority".

Clause 2, Article 169 of the 2019 Labor Code stipulates the retirement age: "The retirement age of workers in normal working conditions is adjusted according to a roadmap until reaching 62 years old for male workers in 2028 and 60 years old for female workers in 2035. From 2021, the retirement age of workers in normal working conditions is 60 years and 03 months for male workers and 55 years and 04 months for female workers; then, each year increases by 03 months for male workers and 04 months for female workers.

Clause 2, Article 4 of Decree No. 135/2020/ND-CP stipulates the retirement age in normal working conditions as follows:

Based on the above regulations, the male Commander of the Commune-level Military Command is a civil servant and is entitled to retirement according to the provisions of the Labor Code, the retirement age of the male Commander of the Commune-level Military Command in normal working conditions in 2026 is 61 years and 06 months.

In case the male Commander of the Military Command at the commune level has reduced working capacity; does a particularly heavy, hazardous, and dangerous job; does a heavy, hazardous, and dangerous job; works in areas with particularly difficult socio-economic conditions, he may retire at an age lower than the retirement age in normal working conditions according to the provisions of Clause 3, Article 169 of the 2019 Labor Code and Decree No. 135/2020/ND-CP and Articles 64, 65 of the 2024 Law on Social Insurance.
