Implementing a special financial mechanism for law making and enforcement

The Politburo issued Resolution No. 66-NQ/TW on innovation in law making and enforcement to meet the requirements of national development in the new era.

In Resolution No. 66-NQ/TW, the Politburo clearly stated the groups of tasks and solutions that need to be implemented to innovate the work of law making and enforcement, meeting the requirements of national development in the new era.

The Resolution clearly states the tasks and solutions for improving the effectiveness of international cooperation and international law:

Accordingly, perfecting mechanisms, improving the capacity of Vietnamese agencies and organizations to ensure full implementation of international legal obligations, shaping international legal order, actively participating in the building of international institutions and laws, effectively and flexibly taking advantage of the advantages from the commitments of international treaties to which Vietnam is a member.

Handling arising international legal issues, especially international investment and trade disputes to promptly protect national and ethnic interests, the legitimate rights and interests of individuals, organizations, enterprises, and state agencies of Vietnam.

Implement a special mechanism to attract, recruit, train and foster highly qualified human resources with practical experience in international law and international cooperation in law, resolve international disputes, and develop a strategy to increase the presence of Vietnamese experts in international legal organizations and international arbitration agencies.

Expanding international cooperation in law and justice; building and developing a network of foreign legal experts, including overseas Vietnamese to support research and consultation on new issues in socio-economic development, science, technology, innovation and digital transformation.

Resolution 66-NQ/TW also clearly states the group of tasks and solutions for implementing special financial mechanisms for law making and enforcement:

Accordingly, the mechanism for allocating, managing and using the budget for law-making work is innovated on the principle of timeliness, correctness, sufficientness and closeness to expenditures according to the results and products of each task and activity.

The head of the agency assigned with the task and activities of law-making is authorized to take the initiative and be responsible before the law in allocating, managing and using the assigned funds.

Ensure that spending on law-making work is not lower than 0.5% of total annual budget expenditure and gradually increase according to development requirements.

Establish a Fund to support the development of policies and laws guaranteed by the state budget, combining legal socialized funding sources from domestic organizations and individuals, contributing to supporting and improving the quality of law-making work; ensuring effectiveness associated with public and transparent management, preventing and stopping all manifestations of profiteering and policy direction.

Arrange appropriate budget sources commensurate with the work of organizing law enforcement. Prioritize resources commensurate with the dissemination and education of the law, and legal aid for special, disadvantaged groups and ethnic minorities.
