Deputy Head of commune-level department eligible to be ranked as chief specialist

The Ministry of Home Affairs has just issued a document responding to the Department of Home Affairs of Dien Bien province regarding the ranking of civil servant ranks according to job positions, as stipulated in Decree 361/2025/ND-CP of the Government.

In which, the Ministry of Home Affairs guides the ranking of principal specialist rank or equivalent for Deputy Heads of commune-level specialized agencies.

According to the provisions of point c, clause 3, Article 9 of Decree No. 361/2025/ND-CP, the job position of professional and nghiệp vụ civil servants at the commune level is determined in the rank of specialist and equivalent, cadre and equivalent.

Point a, Clause 1, Article 9 of Decree No. 361/2025/ND-CP stipulates: Civil servants assigned to which job positions are ranked according to that job position. The rank of civil servants according to job positions for professional and nghiệp vụ civil servants must be based on the job description and competency framework of the job position.

At the same time, point b, clause 3, Article 9 of Decree No. 361/2025/ND-CP stipulates: Ranking principal specialists for: Deputy heads of specialized agencies under the province; heads and deputy heads of organizations under the organizational structure of specialized agencies under the province; civil servants of specialized agencies under the province are arranged in the position of principal specialist and equivalent. Heads and deputy heads of specialized agencies under communes.

Therefore, for Deputy Heads of Departments under commune-level specialized agencies who meet the standards and conditions of the principal expert rank and at the same time ensure the ratio of principal expert rank for deputy heads of specialized agencies as prescribed in point b, clause 2, Article 8 of Decree No. 361/2025/ND-CP, they are ranked as principal experts and equivalents.
