Passport revoked, invalidated in 3 new cases

Law 118/2025/QH15 supplements cases of revocation and cancellation of the validity of passports in Article 27 of the Law on Entry and Exit of Vietnamese citizens.

According to Law 118/2025/QH15, effective from July 1, 2026, amending and supplementing 10 laws related to security and order, heads of specialized agencies under the commune-level People's Committees are granted official passports.

In which the Law supplements cases of revocation and cancellation of the validity of passports in Article 27 of the Law on Entry and Exit of Vietnamese citizens to suit reality, including:

(1) Cancellation of the validity of a valid ordinary passport for cases where a new ordinary passport has been issued;

(2) Revocation or cancellation of the validity of the passport that has been issued but the information on the passport is incorrect;

(3) Cancellation of the validity of the passport of the person being wanted.

At the same time, adding 2 new articles (Article 31a, Article 31b) in the Law on Entry and Exit of Vietnamese Citizens stipulating the procedures for recovering and canceling the validity of the above-mentioned passport.

Previously, Article 27 of the Law on Entry and Exit of Vietnamese Citizens in 2019 stipulated 4 cases of revocation and cancellation of passport validity, including:

(1) Cancellation of the validity of the lost valid passport

(2) Revocation and cancellation of the validity of the passport of a person who is granted revocation of nationality, deprived of Vietnamese citizenship, or whose decision to naturalize Vietnamese citizenship is revoked.

(3) Revocation and cancellation of the validity of diplomatic passports and official passports that are still valid in cases where they are no longer eligible for use.

(4) Revoking or canceling the validity of the passport issued to a person in the case specified in Clause 1, Article 21 of this Law.

Regarding the cancellation of the validity of the ordinary passport, Article 28 of the Law on Entry and Exit of Vietnamese Citizens in 2019 stipulates as follows:

a) Within 48 hours from the time of discovering the loss of the ordinary passport, the person who loses the passport shall directly submit or send a declaration of loss according to the form to the Immigration Management Agency where it is convenient, the nearest Police agency or the Immigration control unit at the border gate or the Vietnamese representative agency abroad where it is convenient. In case of force majeure, the deadline for submitting or sending a declaration of loss may be longer, but the declaration must specifically explain the force majeure reason;

b) Within 1 working day from the date of receiving the notification of loss of the ordinary passport, the receiving agency is responsible for notifying according to the form to the Immigration Management Agency of the Ministry of Public Security and the sender of the application. Within 1 working day from the date of receiving the notification, the Immigration Management Agency of the Ministry of Public Security shall cancel the validity of the passport.
