Civil servants and public employees need to re-register their birth without confirmation from the head

When registering for reborn, civil servants, public employees, and armed forces do not require confirmation from the head of the agency if there is information in the system.

This is the content stipulated in Decree No. 18/2026/ND-CP of the Government amending and supplementing a number of decrees to reduce and simplify administrative procedures and business conditions under the management of the Ministry of Justice.

The Decree amends and supplements Point c, Clause 1, Article 26 on re-registering birth for cadres, civil servants, and public employees (CBCCVC), and people working in the armed forces in the direction of removing the requirement to submit a confirmation document from the head of the agency or unit if the competent authority exploits relevant information on database systems.

Accordingly, in case the person applying for re-registry for birth is a civil servant or a person working in the armed forces, in addition to the prescribed documents, there must be a document confirming the birth certificate of the head of the agency or unit about the birth certificates of that person.

In case the household registration agency can exploit this information through connection with the Electronic Household Database, National Population Database, and CBCCVC Database, the requirements for the competent authority do not have to submit a confirmation document from the head of the agency or unit.

The Decree also amends and supplements the process of verifying documents for requests for re-registry of birth and re-registry of marriage when implemented at the People's Committee of a commune other than the previous registration place in the direction that judicial officers check information about previous birth/marriage registration on the Electronic Civil status Database through the professional practice of providing a copy; use this lookup result as a basis to determine the conditions for re-registry.

Instead of having to confirm the document from the People's Committee of the place of registration of birth/marriage previously, within 5 working days from the date of receipt of the dossier, the judicial - civil status official will check and verify the dossier.

If the registration of rebirth is in accordance with the provisions of law, the judicial - civil status civil servant shall register the rebirth according to the procedures prescribed in Clause 2, Article 16 of the Law on Civil Judgment.

If the re-registry of birth is carried out at the People's Committee at the commune level that is not the place where the birth was previously registered, the judicial - civil status civil servant shall look up information about the previous birth registration of the person requesting the birth on the Electronic Civil status Database through the professional agency's copy issuance, the lookup results will be the basis for determining whether the conditions are met or not met to re-register.

Within 5 working days from the date of receipt of the dossier, the judicial - civil status civil servant shall check and verify the dossier.

If the registration file for remarriage is complete, accurate, and in accordance with legal regulations, the judicial - civil status civil servant shall re-register the marriage according to the procedures prescribed in Clause 2, Article 18 of the Law on Civil Judgment.

If the re-registry of marriage is carried out at the People's Committee at the commune level that is not the place where the marriage was previously registered, the judicial - civil status civil servant shall look up information about the previous marriage registration of the person requesting the marriage on the Electronic Civil status Database through the professional agency to issue a copy, the search results will be the basis for determining whether the conditions are met or not met to re-register.
