Time of social insurance payment decides salary scale when recruiting new civil servants
From March 1, 2026, civil servants who have worked and paid compulsory social insurance will be paid according to the new guidelines.
Circular No. 1/2026/TT-BNV guides salary arrangement for people recruited as civil servants who have worked and participated in compulsory social insurance (SI). This regulation is implemented according to Article 20 of Decree No. 170/2025/ND-CP of the Government and officially takes effect from March 1, 2026.
According to the Circular, salary classification for civil servant recruitment is not only based on the rank and grade according to job position but also takes into account the working period with previous compulsory social insurance contributions.
Principles of salary classification
Article 2 of Circular 1/2026/TT-BNV clearly states that salary classification must be based on actual working time with compulsory social insurance contributions, in accordance with the requirements of professional qualifications and skills of the recruited job position.
In case the working period is not continuous but the employee has not received a one-time social insurance allowance, the social insurance payment period will still be accumulated as a basis for salary classification. At the same time, the recruited person must be arranged to work in accordance with the expertise and profession he/she has previously held.
Cases where salary is not calculated
The Circular also clearly stipulates that working time with compulsory social insurance contributions but not in accordance with the requirements of professional qualifications and skills of the recruited job position will not be counted for salary classification in the corresponding civil servant rank.
This is to ensure the principle of arranging the right salary for the right person and job, avoiding the situation of accumulating working time not related to recruitment positions.
Responsibilities of recruiting agencies
The competent authority recruiting civil servants is responsible for specifically determining the working period with compulsory social insurance contributions according to the provisions of law, associated with work that meets the professional and technical requirements of the recruitment position to serve as a basis for salary classification for the successful candidate.
The new regulation is expected to ensure the rights of people with working experience, while improving transparency and fairness in recruitment and salary classification for civil servants.
