Cases of dismissal from village head in Hanoi from July 1st
From July 1, the dismissal of village heads and residential group leaders is decided at a meeting of the residential community for some cases.
Hanoi City People's Council has just passed a Resolution regulating the organization and operation of villages and residential groups; titles, quantities, regimes, and policies for non-specialized workers in villages and residential groups in the city.
This Resolution takes effect from July 1, 2026.
In which, Article 12 stipulates cases of dismissal from village heads and residential group leaders.
The dismissal of village heads and residential group leaders is decided at a meeting of the residential community for the following cases:
- The person who requests resignation from the position of village head or residential group leader due to health reasons, family circumstances or for other reasons according to personal wishes has a letter sent to the Chairman of the commune-level People's Committee stating the reasons for resignation;
- Head of the Fatherland Front Work Committee in villages and residential groups proposes that the Chairman of the Commune-level People's Committee consider allowing dismissal in cases where village heads and residential group leaders are no longer trusted by the people, do not complete their tasks, violate the people's right to mastery, are corrupt, wasteful, do not obey the direction and administration of the Commune-level People's Committee, regulations of superiors, violate the law but have not reached the level of criminal prosecution or when at least 50% of the total number of households or representatives of households in villages and residential groups propose.
- The dismissal of village heads and residential group leaders shall be carried out in accordance with the order and procedures specified in Article 13 of this Resolution.
Article 13 stipulates the organization of meetings to dismiss village heads and residential group leaders.
Heads of Fatherland Front Work Committees in villages and residential groups convene and chair meetings of the residential community to dismiss village heads and residential group heads. In case village heads and residential group heads are also Heads of Fatherland Front Work Committees, the Chairman of the Commune-level People's Committee shall convene and chair meetings after agreeing with the Chairman of the Commune-level Vietnam Fatherland Front Committee.
The order of organizing meetings of the residential community to dismiss village heads and residential group leaders shall be implemented according to the provisions of Clause 5, Article 3 of Decree No. 59/2023/ND-CP.
The decision of the residential community on dismissing village heads and residential group leaders is approved when over 50% of the total number of household representatives in the village and residential group approve.
Within 5 working days from the date of receiving the decision that has been voted on by the residential community, the commune-level People's Committee shall consider and issue a decision recognizing the results of dismissal from the position of village head or residential group head. In case a decision recognizing the results of dismissal from the position of village head or residential group head is not issued, it must be answered in writing and clearly state the reason.
In case the meeting does not agree to dismiss the village head or neighborhood group leader, the commune-level People's Committee shall consider and decide after agreeing with the commune-level Vietnam Fatherland Front Committee.
In case the meeting of the residential community on dismissal from village heads and residential group leaders does not have enough household representatives attending to achieve a voting ratio of approval as prescribed, it shall be implemented by issuing household opinion forms according to Article 4 of Decree No. 59/2023/ND-CP and legal regulations on implementing democracy at the grassroots level.
Within 60 days from the date of the decision recognizing the resignation of village heads and residential group leaders, the commune-level People's Committee decides on the election of new village heads and residential group leaders. The election of new village heads and residential group leaders shall be carried out in accordance with the provisions of Article 8, Article 9, Article 10 and Article 11 of this Resolution.
During the period of vacancy of village heads and residential group leaders, the commune-level People's Committee shall agree with the commune-level Vietnam Fatherland Front Committee to decide to appoint temporary village heads and residential group leaders to manage the activities of villages and residential groups until a new village head or residential group leader is elected.
Standing Vice Chairman of Hanoi People's Committee Duong Duc Tuan has just signed and issued Official Dispatch No. 2341/UBND-NC on the implementation of Directive No. 21/CT-TTg dated May 20, 2026 of the Prime Minister.
The City People's Committee requests the People's Committees of communes and wards to urgently organize the dissemination and implementation of Directive No. 21/CT-TTg and the direction of the City People's Committee to agencies, units, organizations, villages, and residential groups in the area; proactively report to the Party Committee of communes and wards to lead and direct the unified process of reviewing and developing the Project, organize to collect people's opinions and implement it after it is approved by competent authorities.
Review all existing villages and residential groups, including the number of households, population, managed area, population characteristics, historical and cultural factors, customs, beliefs, religions, infrastructure conditions, cultural institutions, security and order situation, and non-specialized personnel in villages and residential groups.
Develop a Project on arranging villages and residential groups in the area; organize to collect people's opinions in accordance with legal regulations; summarize, receive, and explain people's opinions; complete dossiers to submit to the Commune People's Council for approval before June 30, 2026.
