The Ministry of Finance responds to the proposal to consider exempting health insurance certification fees for people
Voters recommended that the Ministry of Finance consider submitting to the Government to exempt health certificate fees for people; adjust contract fees according to asset value.
The Ministry of Finance has issued a document responding to the petition of voters in Ninh Binh province sent before the 10th Session of the 15th National Assembly.
Accordingly, voters recommended that the Ministry of Finance consider submitting to the Government to exempt health certificate fees for people; adjust contract fees according to asset value.
Regarding this content, Minister of Finance Nguyen Van Thang said that at point 4, section XII, part A of the fee and charge portfolio issued with the Law on Fees and Fees, the clause "Certificate fee ( Certificate of copy from the original, certificate fee for signature, transaction contract certification fee)" is under the authority of the Ministry of Finance. The law on fees and charges does not stipulate the "medical certificate fee" and "contract fee".
"I request the National Assembly delegation of Ninh Binh province to discuss specifically with voters about the content of this petition so that the Ministry of Finance has full information to answer specifically" - Minister of Finance Nguyen Van Thang stated.
Clause 4, Article 20 of the Law on Fees and Charges also stipulates the responsibilities of the Ministries such as: Requesting the Government or the Ministry of Finance on the collection, payment, exemption, reduction, management and use of each fee and charge in the management of the industry or field.
Based on legal regulations on fees and charges, the Ministry of Finance issued Circular No. 226/2016/TT-BTC dated November 11, 2016 regulating the collection rate, collection, payment, management and use of certificates.
In which, the fee for certifying copies of the original and the fee for certifying transaction contracts according to contracts and transactions are stipulated; there is no regulation on the fee for certifying transaction contracts according to asset value or contract value.
Circular No. 257/2016/TT-BTC dated November 11, 2016 stipulates the collection rate, collection, payment, management and use of notary fees; certification fees; fees for appraisal of standards and conditions for practicing notarization; fees for appraisal of conditions for operation of notary offices; fees for issuing notary cards. In which, the fee for certifying copies from the original is regulated.
Therefore, in case it is necessary to exempt, reduce, amend and supplement the level of certification fee collection, voters of Ninh Binh province are requested to submit a proposal to the Ministry of Justice to synthesize and develop a fee collection project to the Ministry of Finance for the Ministry to study, develop and promulgate Circulars amending and supplementing Circular No. 226/2016/TT-BTC and Circular No. 257/2016/TT-BTC according to regulations.
