Ministry of Public Security explains proposal to increase fines 15 times within the authority of traffic police
In documents sent for appraisal, the Ministry of Public Security stated the reason for the proposal to increase the fine level by 15 times within the authority of the traffic police.
The Ministry of Justice has just publicly disclosed the Appraisal Dossier for the draft Decree amending and supplementing a number of articles of Decree No. 168/2024/ND-CP of the Government stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring points for driver's licenses.
Notably, in the draft Decree, the Ministry of Public Security - the drafting agency - proposed that the maximum fine for People's Police officers on duty increase from 500,000 VND to 7,500,000 VND, which is 15 times higher; Commune-level police chiefs have the right to fine up to 37,500,000 VND;
Heads of Police stations, Heads of Mobile Police units at battalion level, Heads of stations, Team Leaders have the right to fine up to 15,000 VND;...
Explaining these proposals, the Ministry of Public Security said that the amendment and supplementation of regulations on the authority to sanction administrative violations for positions in the People's Police to be consistent with Decree No. 189/2025/ND-CP dated July 1, 2025 of the Government detailing the Law on Handling of Administrative Violations on the authority to sanction administrative violations.
The draft Decree also amends and supplements a number of violations of transport business vehicles to be consistent with the law on road transport business: Driving transport business vehicles under contracts to pick up and drop off officials, civil servants, public employees, and workers at the wrong location in the signed transport contract; picking up and dropping off passengers at the head office, branch office, representative office or at another fixed location leased or cooperated by transport business units; having electronic contracts but not in accordance with regulations, or arbitrarily changing the information of electronic contracts, signed passenger lists; driving cars not engaged in passenger and cargo transportation but carrying people and goods for money or signing contracts, receiving reservations to carry people and goods on the car.
According to the Ministry of Public Security, the purpose of issuing the Decree is to ensure completeness, comprehensiveness, and uniformity in the system of legal documents on handling administrative violations, order, and road traffic safety, to facilitate the application of law, and to overcome obstacles and inadequacies arising from practice in order to enhance the effectiveness and efficiency of state management;
Ensuring the safety of life and health for traffic participants, building a social order, discipline, and safety, contributing to better ensuring human rights and citizens' rights.
The development of the Decree aims to tighten discipline in the compliance with legal regulations on road traffic order and safety, especially for organizations, individuals and drivers of transport business vehicles.
