Ministry of Home Affairs guides allowances for particularly difficult areas
The Ministry of Home Affairs provides guidance on the subjects and time for calculating allowances and allowances for people working in particularly difficult areas according to Decree 76/2019/ND-CP.
In the official dispatch guiding the handling of some difficulties and obstacles in the process of implementing the Government's decrees sent to the Department of Home Affairs of Lam Dong province, the Ministry of Home Affairs has guided some contents related to Decree No. 76/2019/ND-CP on policies for cadres, civil servants, public employees, laborers and armed forces working in areas with particularly difficult socio-economic conditions.
Regarding the determination of areas with particularly difficult socio-economic conditions, the Ministry of Home Affairs said that according to Clause 2, Article 1 of Decree No. 76/2019/ND-CP, these areas include communes in Region III belonging to ethnic minority and mountainous areas, and island communes with particularly difficult conditions according to the Prime Minister's decision.
According to Decree No. 272/2025/ND-CP, the Provincial People's Committee is responsible for approving the list of villages in ethnic minority and mountainous areas, and particularly difficult villages in the area; The Ministry of Ethnic Minorities and Religions summarizes and announces the list of villages and communes in ethnic minority and mountainous areas, especially difficult villages and communes in regions I, II, III nationwide.
On that basis, the Minister of Ethnic Minorities and Religious Affairs issued Decision No. 60/QD-BDTTG dated January 29, 2026 and Decision No. 104/QD-BDTTG dated February 27, 2026 announcing the list of villages and communes in ethnic minority and mountainous areas, particularly difficult villages, and communes in regions I, II, III in the period 2026-2030.
Regarding the subjects of application in Clause 2, Article 2 of Decree No. 76/2019/ND-CP, the Ministry of Home Affairs said that these are people working according to the provisions of Decree No. 68/2000/ND-CP, Decree No. 161/2018/ND-CP and amended and supplemented documents.
For initial allowances when receiving work in areas with particularly difficult socio-economic conditions, Article 6 of Decree No. 76/2019/ND-CP stipulates that this regime applies to subjects under Article 2 of the decree when receiving initial work at agencies, organizations, and units in particularly difficult areas.
The Ministry of Home Affairs also cited the provisions of Article 5 and Article 13 of Decree No. 76/2019/ND-CP on long-term work allowances and actual working time in areas with particularly difficult socio-economic conditions as a basis for calculating enjoyment of allowances and subsidies.
