Regulations on 5 years of working experience for people admitted to civil service

Mr. Nguyen Van An (character name has been changed) said that the locality is currently facing difficulties in recruiting civil servants for non-specialized personnel at the commune level.

According to Mr. An, many cases have worked for more than 10 years in professional positions, have paid full social insurance and meet other conditions to be considered for recruitment as civil servants. However, they do not meet the conditions because they have just completed the university articulation program and the time to have a university degree is not enough 5 years.

According to the provisions of point b, clause 3, Article 13 of Decree 170/2025/ND-CP, subjects admitted to civil service must have worked for 5 years or more, have paid compulsory social insurance and work in a job with professional and nghiệp vụ requirements suitable to the expected job position.

From the above regulations, Mr. An wondered: In case a person has a professional college degree, has worked in the right professional position continuously for more than 10 years, then studied continuously and was awarded a university degree, is the professional working time before obtaining a university degree counted to determine the condition of 5 years of work experience or not?

Regarding Mr. An's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.

According to the provisions of point b, clause 3, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, the recipient is required to have 5 years or more of service in accordance with the law, have compulsory social insurance contributions, and do a job with professional and nghiệp vụ requirements suitable for the job position expected to be received.

This regulation inherits previous decrees implementing the Law on Cadres and Civil Servants No. 22/2008/QH12. The setting of the 5-year working period condition aims to ensure the quality of the civil servant team when receiving cases working at agencies, organizations, and units with different functions and tasks to become civil servants.
