People who have enjoyed the staff streamlining policy can sign contracts
Hanoi - People's Committees of communes and wards consider signing contracts with cases that have enjoyed the staff streamlining policy.
Hanoi City People's Committee has just reported on the results of resolving and responding to voters' recommendations before the 28th session of the City People's Council, 16th term, 2021-2026.
Accordingly, voters of Delegation No. 17, 28 said that implementing the policy of streamlining the apparatus and arranging administrative units, many part-time officials, including the vice chairman of the Commune Women's Union, had to quit their jobs or change to other positions. While most of these are people with capacity, experience, and desire to continue to contribute, but to create conditions for arranging officials, the comrades voluntarily resigned according to Decree No. 154.
Voters proposed that the City People's Committee have guidance on dossiers, procedures for implementing the regime; have a mechanism to arrange suitable jobs (training, fostering, and job transfer) for capable officials, especially female officials.
Regarding voters' recommendations, Hanoi City People's Committee said that in order to promptly resolve regimes and policies for non-specialized personnel at the commune level, based on advice from relevant specialized departments, the Chairman of the City People's Committee issued Decision No. 5514/QD-UBND dated November 10, 2025 authorizing the Chairman of the commune-level People's Committee to approve the list of subjects and funds for streamlining staff for non-specialized personnel at the commune level according to Decree No. 154/2025/ND-CP.
The Department of Home Affairs has issued guidance for agencies and units on subjects, dossiers, order, procedures and progress of settlement of regimes and policies in Official Dispatch No. 7297/SNV-XDCQ dated December 2, 2025.
Accordingly, for cases that have submitted requests for staff reduction at the time of July 1, 2025 or August 1, 2025, individuals and relevant agencies, organizations, and units shall supplement and complete dossiers for consideration and decision according to their authorized authority.
Thus, the city has authorized and issued guidelines for the People's Committees of communes and wards to proactively review, consider, and approve the list and funding for implementing regimes and policies, contributing to shortening the processing time of dossiers and ensuring the legitimate rights and interests of subjects.
Regarding the proposal to have a mechanism for arranging jobs, training, fostering, and transferring positions for people with capacity and experience, especially female officials, the City People's Committee acknowledges that this is a human resource that has a working process, understands the area, has practical experience, propaganda and mobilization skills for people and is capable of meeting task requirements at the grassroots level.
The fact that non-specialized workers at the commune level who have quit their jobs and enjoy policies according to Decree No. 154/2025/ND-CP continue to participate in working at agencies, organizations, and units may be considered through contract forms according to the provisions of law.
According to the professional guidance of the Ministry of Home Affairs, cases that have enjoyed the staff streamlining policy are allowed to sign contracts to perform civil servant duties according to Decree No. 173/2025/ND-CP; sign contracts to perform public employee work according to Decree No. 111/2022/ND-CP or sign other labor contracts other than staff quotas, norms for the number of employees, not subject to the case of having to return the amount of allowance received according to Clause 6, Article 3 of Decree No. 154/2025/ND-CP.
On that basis, the People's Committees of communes, wards and relevant agencies and units shall base on the requirements of tasks, the current situation of human resources, job positions, funding sources and standards and conditions of each individual to consider signing contracts in accordance with the scope, subjects, order, procedures and authority regulations.
