Proposal to increase the level of toxic compensation for workers
Propose to increase the level of toxic compensation and consider amending regulations in the direction of allowing cash allowance payments.
Mr. Vu Anh Tuan - Vice President of the Vietnam Health Trade Union - said that through the synthesis of the Vietnam Health Trade Union, union members and workers in the health sector proposed to amend and supplement some shortcomings in current legal documents that are no longer suitable.
In particular, many opinions said that currently, the implementation of the compensation regime in kind for employees working in conditions with dangerous factors and harmful factors according to Circular 24/2022/TT-BLDTBXH is regulated according to the principle: Employers must provide in-kind compensation for employees to use for the purpose of compensation.
However, according to opinions, the nutritional needs and the ability to use nutritious foods of each worker are different, leading to the supplied artifacts not always being suitable.
In addition, the process of organizing bidding for the procurement of compensatory materials at many units has encountered many difficulties, especially for units with a need to buy in small quantities, making the organization of bidding unfavorable, hindering the implementation of policies for workers.
Union members and workers in the health sector recommended that the Ministry of Health review, amend and supplement inappropriate regulations related to ensuring occupational safety and hygiene in the health sector; propose raising the level of toxic compensation and consider amending regulations in the direction of allowing the payment of cash allowances, creating conditions for workers to proactively purchase items suitable to actual needs, overcoming the situation where some units encounter difficulties in the bidding process, leading to not fully implementing the regime for workers.
Ms. P.T.L - a medical staff in Bac Ninh province expressed her agreement with the proposal to allow cash allowances. "This will facilitate workers to buy artifacts suitable to the conditions of workers, taking better care of their health," Ms. P.T.L shared.
In addition, Ms. P.T.L also agreed with raising the level of toxic allowances to better care for workers.
Currently, Clause 1, Article 4 of Circular 24/2022/TT-BLDTBXH stipulates that compensation in kind is calculated according to the daily rate and is worth money according to the following compensation levels: Level 1: 13,000 VND; Level 2: 20,000 VND; Level 3: 26,000 VND; Level 4: 32,000 VND.
According to the Circular, one of the principles for organizing in-kind compensation is: Not paid in cash, not paid in salary (including including including including included in salary items) instead of in-kind compensation.
