The Ministry of Public Security abandoned the proposal for 1 clause related to examination and promotion
Initially, the Ministry of Public Security proposed that the driving license and promotion test must still have points, be valid, and prevent serious traffic accidents.
The Drafting Committee of the Ministry of Public Security has just published a summary of opinions, accepted and explained comments on the draft Circular amending and supplementing a number of articles of Circular No. 12/2025/TT-BCA dated February 28, 2025 of the Minister of Public Security regulating the testing, issuance of driving licenses; issuance and use of international driving licenses.
Before promulgating the draft, the Drafting Committee proposed to amend and supplement a number of points and clauses of Article 15.
In which, Clause 3 is added to Article 15 as follows: In the case of the promotion test, the driving license must still have points, be valid, and there must be no road traffic accidents causing serious or very serious consequences or especially serious consequences from the time the training course is granted to the time the driving test is held.
In response to the above proposal, there were opinions and stated that Clause 3, Article 15 proposes to have specific instructions on the method of verifying whether candidates have had traffic accidents or not so that the work of making a list of candidates eligible for driver testing can take place quickly and effectively, ensuring the provisions of law. Additional regulations for such traffic accidents where the candidate's fault is the cause of the accident.
Regarding the above opinion, the Drafting Committee (Traffic Police Department) of the Ministry of Public Security said that after reviewing the draft Circular, the drafting committee removed the regulation to add Clause 3 to Article 15.
According to the drafting committee, because Clause 3, Article 19 of Circular No. 12 stipulates: Not yet tested for driving license issuance for violators of road traffic order and safety has not yet completed the request of the competent state agency on resolving and handling administrative violations in the field of road traffic order and safety.
The Traffic Police Department where the test is held must review the violations of candidates taking the exam before the tests.
"Therefore, the regulation in Clause 2 is unnecessary," the drafting committee stated.
