From August 15th, the Chairman of the People's Committee and the Head of the Commune Police are officially fined up to 37.5 million VND

From August 15, the Chairman of the People's Committee and the Head of the Commune-level Police are given the authority to sanction administrative violations in the field of road traffic with a maximum fine of up to 37.5 million VND.

According to Decree 238/2026/ND-CP of the Government amending and supplementing a number of articles of Decree 168/2024/ND-CP on sanctioning administrative violations in the field of road traffic, the sanctioning authority of the Chairman of the Commune-level People's Committee has been significantly increased.

Specifically, Article 13 of Decree 238 amending Article 42 of Decree 168 stipulates that the Chairman of the Commune-level People's Committee is fined a maximum of 37.5 million VND, instead of the maximum of 5 million VND according to current regulations.

Decree 238 also amends and supplements Article 43 of Decree 168 on the sanctioning authority of the People's Police force.

Accordingly, People's Police officers on duty are entitled to a warning; fines up to 7.5 million VND; confiscation of exhibits and means of administrative violations worth no more than 15 million VND. Previously, the maximum fine for this force was only 500,000 VND.

For Heads of Mobile Police units at the company level, the authority to impose penalties is increased to a maximum fine of 15 million VND and they are allowed to confiscate exhibits and means of administrative violations worth no more than 30 million VND. According to current regulations, the maximum fine for this title is 1.5 million VND.

Notably, the Head of the Commune-level Police has the right to issue a warning; fine up to 37.5 million VND; revoke the right to use licenses and professional certificates for a limited time or suspend operations for a limited time; confiscate exhibits and means of administrative violations and apply remedial measures according to regulations.

Compared to current regulations, the authority of the Head of the Commune-level Police has been significantly expanded. Previously, this title was only fined a maximum of 2.5 million VND and confiscated exhibits and means of violation worth no more than 5 million VND.

In addition to adjusting the sanctioning authority, Decree 238 also supplements Clause 3a to Article 29 of Decree 168, stipulating a fine of 5 - 10 million VND for drivers of road traffic rescue vehicles who commit one of the acts such as carrying rescue vehicles exceeding the permitted carrying capacity; pulling vehicles exceeding the permitted weight recorded in the inspection certificate or pulling vehicles not to the right rescued subjects according to the provisions of law.

People who violate the above acts will also be deducted 2 points from their driver's license.

Notably, Decree 238 also abolished the form of vehicle confiscation for cases of re-offending some acts such as carrying over 100% of the prescribed number of people, carrying overloaded goods over 150% or arbitrarily changing the size of the truck bed not in accordance with technical parameters.
