According to Decree 238/2026/ND-CP of the Government amending and supplementing a number of articles of Decree 168/2024/ND-CP on sanctioning administrative violations in the field of road traffic, the sanctioning authority of the Chairman of the Commune-level People's Committee has been significantly increased.

Specifically, Article 13 of Decree 238 amending Article 42 of Decree 168 stipulates that the Chairman of the Commune-level People's Committee is fined a maximum of 37.5 million VND, instead of the maximum of 5 million VND according to current regulations.

Decree 238 also amends and supplements Article 43 of Decree 168 on the sanctioning authority of the People's Police force.

Accordingly, People's Police officers on duty are entitled to a warning; fines up to 7.5 million VND; confiscation of exhibits and means of administrative violations worth no more than 15 million VND. Previously, the maximum fine for this force was only 500,000 VND.

For Heads of Mobile Police units at the company level, the authority to impose penalties is increased to a maximum fine of 15 million VND and they are allowed to confiscate exhibits and means of administrative violations worth no more than 30 million VND. According to current regulations, the maximum fine for this title is 1.5 million VND.

People who violate the above acts will also be deducted 2 points from their driver's license.

Notably, Decree 238 also abolished the form of vehicle confiscation for cases of re-offending some acts such as carrying over 100% of the prescribed number of people, carrying overloaded goods over 150% or arbitrarily changing the size of the truck bed not in accordance with technical parameters.
