Allowance money for the Village Head who resigned due to arrangement when he was past retirement age
The Labor Law Consulting Department answers readers regarding the allowance for the Village Head who resigned due to arrangement when he was past retirement age.
Reader asks: I was the Village Head from September 2009 to the end of June 2026, resigning due to village arrangement. I was born in September 1960, male, the allowance upon resignation is 2,808,000 VND/month. So am I entitled to the regime according to Article 10 of Decree 154/2025/ND-CP? If so, how much is the allowance?
The Labor Law Consulting Department said:
Based on information provided by readers: Head of village from September 2009 to the end of June 2026, resigned due to village arrangement; Born September 1960 (male); Head of village allowance at the time of resignation is 2,808,000 VND/month.
Comparing the provisions of Article 10 of Decree 154, this case has reached retirement age according to the roadmap specified in Appendix I issued together with Decree No. 135/2020/ND-CP.
Therefore, the policies specified in Clause 1, Article 10 (subsidies based on the number of years of service, number of months of early retirement...) are not applied, but fall into the cases specified in Clause 3, Article 10 of Decree 154/2025/ND-CP.
Clause 3, Article 10 of Decree 154/2025/ND-CP stipulates:
Non-specialized workers in villages and residential groups who have reached retirement age according to the provisions of Appendix I, Appendix II issued together with Decree No. 135/2020/ND-CP or are enjoying retirement benefits or loss of working capacity benefits are entitled to a one-time allowance equal to 15 months of monthly allowance currently enjoyed".
Thus, with the current allowance level of 2,808,000 VND/month, the one-time allowance amount is calculated as follows:
2. 808,000 VND × 15 months = 42,120,000 VND.
Therefore, if the resignation of the reader is due to village arrangement according to the decision of the competent authority and is subject to the application of Article 10 of Decree 154, then he is entitled to a one-time allowance of 42,12 ,000,000 VND.
Notably, due to being eligible for retirement age, this case is not entitled to the allowances specified in Clause 1, Article 10 such as:
Allowance of 1.5 times the allowance for each year of work;
Subsidy of 0.8 times the allowance according to the number of months of work or the number of months of early retirement;
3-month allowance to find a job.
These regimes only apply to people who have not reached retirement age according to the provisions of Clause 1, Article 10 of Decree 154/2025/ND-CP.
