Subsidy for Village Party Secretary resigning due to merger after 20 years of work

According to the provisions of Clause 1, Article 14 of Decree No. 185/2026/ND-CP, the Village Party Cell Secretary is a non-specialized person working in the village.

Clause 5, Article 2 of Decree No. 154/2025/ND-CP stipulates the subjects of implementing the staff streamlining policy, which includes non-specialized workers in villages and residential groups who are redundant due to the arrangement of villages and residential groups and quit immediately from the time of the arrangement decision of the competent authority.

Regarding retirement age:

Based on Appendix I issued together with Decree No. 135/2020/ND-CP of the Government regulating the retirement age, male workers born in May 1961 working in normal working conditions are eligible for retirement age at the milestone of 60 years and 03 months.

The time you reach the age of 60 and 03 months is August 2021.

Regarding age at the time of resignation:

By the time of resignation from July 1, 2026, readers are over 65 years old and have reached retirement age according to the provisions of Appendix I issued together with Decree 135/2020/ND-CP.

Comparing with the provisions of Decree 135/2020/ND-CP, at the time of surplus due to village merger (July 1, 2026), you have reached retirement age according to regulations.

Because you are a non-specialized worker in the village who has reached retirement age up to the time of resignation, your case is subject to direct adjustment under Clause 3, Article 10 of Decree No. 154/2025/ND-CP of the Government on streamlining staff.

Based on Clause 3, Article 10 of Decree No. 154/2025/ND-CP stipulates:

3. Non-specialized workers in villages and residential groups who have reached retirement age according to the provisions of Appendix I, Appendix II issued together with Decree No. 135/2020/ND-CP or are enjoying retirement benefits, regimes for working capacity loss are entitled to a one-time allowance equal to 15 months of monthly allowance currently enjoyed".

Current monthly allowance level: 3,744,000 VND/month.

Eligible allowance level: 15 months of current allowance.

Specific allowance level:

15 × 3,744,000 = 56,160,000 VND.

Thus, readers are entitled to a one-time allowance of 56,160,000 VND according to Clause 3, Article 10 of Decree 154/2025/ND-CP.
