Cases where driver's licenses cannot be renewed
The renewal of driver's licenses is regulated in Article 21, Circular 108/2026/TT-BCA of the Ministry of Public Security.
Reader asks: For which cases does the functional agency not change driver's licenses according to current regulations?
The Legal Consulting Department of Lao Dong Newspaper said that Article 21, Circular 108/2026/TT-BCA of the Ministry of Public Security (effective from July 1, 2026) stipulates the renewal of driver's licenses as follows:
Cases of driver's license renewal:
- People with damaged driver's licenses that are no longer usable;
- Vietnamese people, foreigners who already have a driver's license issued by a Vietnamese competent authority before expiring if they need to renew their driver's license;
- In case the date, month, year of birth, full name, middle name, nationality recorded on the driver's license is incorrect with the citizen identification card, ID card or passport, the competent authority shall carry out procedures to change the new driver's license to be consistent with the information recorded in the citizen identification card, ID card or passport;
- People who need to integrate an indefinite driver's license with a fixed-term driver's license;
No change of driver's license for the following cases:
The person requesting to change the driver's license no longer has the issued driver's license and the driver's license information is not in the driver's license information system of the Traffic Police Department or not in the list of driver's license issuance (management book); the person violating the law on road traffic order and safety has not completed the request of a competent state agency on resolving and handling administrative violations in the field of road traffic order and safety.
People can exchange their driver's licenses online at the National Public Service Portal or the National Identification Application or applications of the People's Police force.
In case people do not have level 2 identification or do not have driver's license data in the driver's license information system or due to a fault in the National Public Service Portal system, submit the dossier directly to the commune-level police where the receiving point is arranged or the Traffic Police Department.
Driver's license renewal dossier
- Health certificate of the driver still valid (electronic version), in case due to technical errors, the electronic version cannot be used, use the paper version issued by a medical examination and treatment facility that meets the standards according to the provisions of law on medical examination and treatment;
- Passport with validity (for foreigners, overseas Vietnamese).
In case the date, month, year of birth, full name, middle name, nationality recorded on the driver's license is incorrect with the citizen identification card, ID card or passport, people must prepare some related documents for comparison according to regulations.
