New regulations on revoking driving licenses in 2026
Circular No. 108/2026/TT-BCA of the Ministry of Public Security regulating testing and issuing driver's licenses; issuing and using international driver's licenses takes effect from July 1, 2026.
Article 25 of Circular No. 108/2026/TT-BCA stipulates the revocation of driver's licenses as follows:
The competent authority issuing the driver's license shall carry out the revocation in the following order:
- For driver's licenses already available on the electronic data system, within 3 working days from the date of detection of a person with a driver's license belonging to one of the cases specified in Clause 5, Article 62 of the Law on Road Traffic Order and Safety amended and supplemented by Law No. 118/2025/QH15, the Director of the Traffic Police Department shall issue a decision to revoke and cancel the driver's license (the content of the decision clearly states the reasons for revocation and cancellation) and cancel the integration of electronic driver's licenses on the National Identification Application or applications of the People's Police force as prescribed; individuals are not required to return the driver's license;
- For driver's licenses not on the electronic data system, within 3 working days from the date of detection of a person with a driver's license belonging to one of the cases specified in Clause 5, Article 62 of the Law on Road Traffic Order and Safety amended and supplemented by Law No. 118/2025/QH15, the Head of the Traffic Police Department shall issue a decision to revoke and cancel the driver's license (the content of the decision clearly states the reasons for revocation and cancellation). Within 5 working days from the date of receiving the decision to revoke the driver's license, individuals must submit the revoked driver's license to the Traffic Police Department. The Traffic Police Department is responsible for receiving the revoked and canceled driver's license according to regulations and reporting to the Traffic Police Department.
Handling cases of revoked driver's licenses:
- Driver's licenses are revoked according to the provisions of points a, b, clause 5, Article 62 of the Law on Road Traffic Order and Safety; dossiers and procedures for re-issuance of driver's licenses are implemented according to the provisions of clauses 2, 3, 4, Article 21 of this Circular;
- Driver's licenses are revoked according to the provisions of point c, clause 5, Article 62 of the Law on Road Traffic Order and Safety, the driver's license management agency updates data on violations on the driver's license information system at the Traffic Police Department from the date of detection of the violation; in addition, the person who commits the violation is not granted a driver's license for 5 years from the date of detection of the violation; after 5 years from the date of detection of the violation, if there is a need to reissue a driver's license, they must study and re-examine it as in the case of first-time driver's license issuance.
