Unemployment benefits: Dossiers must have these 3 components from 2026
According to Decree No. 374/2025/ND-CP, the dossier requesting unemployment benefits includes 3 basic components.
The first is to request unemployment benefits according to Form No. 10 issued with the Decree. This is a document expressing the aspirations of employees to receive unemployment benefits when they meet the conditions according to the provisions of law.
The second is documents confirming the termination of labor contracts, working contracts or termination of work.
These documents may be labor contracts or working contracts that have expired or have completed work under contract; resignation decisions, dismissal decisions, disciplinary decisions for dismissal; notices or agreements on termination of labor contracts or working contracts; or written confirmations from employers, clearly stating employee information, type of contract signed, reasons and time of termination of contract.
For cases where employees work under a labor contract with a term of 1 month to less than 12 months, the document confirming the termination of the contract is the original or certified copy of the signed labor contract.
In special cases, when the labor-using unit no longer has a legal representative or a person authorized, the employee may request the Department of Home Affairs to carry out the confirmation of termination of the labor contract according to the order and procedures specified in the Decree.
The third component of the dossier is the social insurance book.
The social insurance agency is responsible for confirming the unemployment insurance contribution period and returning the social insurance book to employees within the prescribed time limit, as a basis for resolving unemployment benefits.
Regarding the application method, employees within 3 months from the date of termination of the labor contract, working contract or termination of work, if they do not have a job and need to receive unemployment benefits, submit 1 set of dossiers directly at the public employment service organization where the employee needs to receive unemployment benefits or submit through the National Public Service Portal.
In case employees encounter difficulties due to illness, maternity, accidents, natural disasters, epidemics or other force majeure events, dossiers can be submitted through the authorized person or sent through postal services as prescribed.
Decree No. 374/2025/ND-CP also clearly stipulates the responsibilities of public employment service organizations in receiving, checking dossiers, scheduling results and submitting to competent authorities to decide on receiving unemployment benefits for employees.
In case the dossier is incomplete or information is unclear, the employee will be required to supplement and complete it to ensure that the settlement is in accordance with regulations. If the employee does not meet the conditions to receive unemployment benefits, respond in writing and state the reason clearly.
