With monthly pensions, people will have to stop receiving unemployment benefits
According to new regulations from 2026, employees will be terminated from receiving unemployment benefits if they receive a monthly pension.
Decree No. 374/2025/ND-CP detailing a number of articles of the Law on Employment on Unemployment Insurance takes effect from January 1, 2026.
One of the notable things of this Decree is Article 19 on terminating unemployment benefits.
Accordingly, cases where employees receiving unemployment benefits are terminated are regulated as follows:
Having an job and being subject to compulsory social insurance according to the provisions of the Law on Social Insurance.
Performing military service, the obligation to join the People's Public Security, the regular militia: The day the employee is determined to perform military service, the obligation to join the People's Public Security, the regular militia is the day the employee enlists.
Receive monthly pension: The date on which the employee is determined to receive pension is the first day of calculating pension as stated in the document of the social insurance agency on receiving monthly pension of the employee.
After 2 times of workers refusing jobs introduced by a public employment service organization that is receiving unemployment benefits without a legitimate reason
Employees who are receiving unemployment benefits and refuse to work in one of the following cases are determined to have no legitimate reasons: Employees who are organized by a public employment service organization and are introduced to a job suitable to their industry, occupation, training level or work that the employee has done but is not registered in the job introduction form but does not come to participate in labor recruitment; employees who have participated in labor recruitment according to the introduction of the public employment service organization where they are receiving unemployment benefits and are recruited by the employer but do not accept the recruited job, except in cases where the job is not as advertised by the employer.
The date on which the employee is determined to have terminated the unemployment benefit is the date for the second time that the employee is in one of the above cases.
During the period of unemployment benefits, 03 consecutive months of not implementing monthly notices on job search to public employment service organizations according to regulations: The date on which the employee is determined to have terminated the unemployment benefits is the end date of the job search notification period for the third consecutive month in which the employee does not implement monthly notices on job search.
Going abroad to settle: The date the employee is determined to settle abroad is the date the employee exits the country according to the provisions of the law on exit and entry.
study abroad for more than 12 months: The date on which the employee is determined to study abroad for more than 12 months is the school admission date stated in the school admission notice.
Administratively sanctioned for violating unemployment insurance laws
The day the employee is determined to be subject to the above administrative violation is the day the employee is subject to the penalty according to the decision of the competent authority.
Death: The date of determination of the employee's death is the date stated in the death certificate.
Comply with the decision to apply the measure of sending to reform schools, compulsory education institutions, and compulsory drug rehabilitation facilities: The date the employee is determined to comply with the decision to apply the measure of sending to reform schools, compulsory education institutions, and compulsory drug rehabilitation facilities is the date of starting to implement the administrative handling measure as stated in the decision of the competent authority.
Declared missing by the court: The date of the missing employee is determined in the court's decision.
Temporarily detained, serving a prison sentence: The date the employee is determined to be temporarily detained, serving a prison sentence is the date of the effective date of the temporary detention decision, serving a prison sentence by the competent authority.
According to the employee's request: The date on which the employee is terminated from receiving unemployment benefits is the date the employee requests the public employment service organization.
