Regulations on subjects who are allowed to retire from receiving 500,000 VND social pension allowance

YouMe Law Company Limited said: Article 4 of Decree 176/2025/ND-CP, the order and procedures for implementing social pension benefits are as follows:

(1) The person requesting social pension benefits has a written request for social pension benefits according to Form No. 01 issued together with Decree 176/2025/ND-CP sent directly or through the postal organization or on the online environment to the Chairman of the People's Committee of communes, wards, special zones directly under the province or city where they reside (hereinafter referred to as commune level);

(2) Within 10 working days from the date of receiving the written request for social pension benefits, the Chairman of the Commune-level People's Committee shall organize the consideration, verification and standardization of relevant information of the social pension applicant with the national population database, decide and implement the payment of social pension benefits to the applicant in accordance with legal regulations.

The time to enjoy monthly social pension benefits is calculated from the month the Chairman of the Commune-level People's Committee signs the decision;

In case the applicant does not meet the conditions to receive social pension benefits, the Chairman of the commune-level People's Committee shall respond in writing, stating the reason.

Note, for cases where subjects currently receiving social pension benefits change their place of residence and request to receive social pension benefits at a new place of residence (according to Form No. 01 issued together with Decree 176/2025/ND-CP), the Chairman of the People's Committee of the commune where the old residence is located decides to terminate the payment of social pension benefits in the area and has a document attached with relevant documents of the applicant to the Chairman of the People's Committee of the commune where the applicant's new place of residence is located.

The Chairman of the People's Committee of the commune where the new residence is located, based on the relevant documents of the applicant, considers and decides to continue the social pension allowance and implement the payment of the social pension allowance from the month of termination of payment at the old place of residence.

In case a subject currently receiving social pension benefits dies or is no longer eligible for social pension benefits as prescribed in Article 2 of Decree 176/2025/ND-CP, the Chairman of the Commune People's Committee decides to terminate the enjoyment of social pension benefits.

The period of termination of social pension benefits is from the month immediately following the month the subject dies or does not meet the conditions to receive social pension benefits.

Therefore, deciding to terminate the monthly social pension allowance of 500,000 VND/month when falling into a case where a social pension beneficiary dies or is no longer eligible for social pension benefits according to the provisions of Article 2 of Decree 176/2025/ND-CP, the Chairman of the Commune People's Committee decides to terminate the social pension allowance.
