Unemployment benefits: Social insurance informs about the authority to handle

Sending a question to the Social Insurance agency, reader N.T.T said: "I have paid social insurance for 6 years and 3 months, due to family circumstances, I applied for leave and was confirmed by the Social Insurance agency for the total time participating in social insurance and unemployment insurance on the social insurance book.

I request the competent authority to guide me on the process of receiving unemployment benefits".

Regarding this issue, Lao Cai Provincial Social Insurance responded as follows:

Clause 3, Article 34, Chapter VIII of Decree No. 374/2025/ND-CP dated December 31, 2025 of the Government detailing a number of articles of the Law on Employment on Unemployment Insurance stipulates the responsibilities of public employment service organizations, which clearly states:

"Organize the reception, consideration and implementation of procedures for handling applications for unemployment benefits, support for training, fostering, and improving vocational skills.

In case during the implementation of online public services, the electronic data on population, social insurance, and unemployment insurance of employees is not consistent with the information on documents with legal value such as Citizen identification cards, social insurance books or other legal documents, the public employment service organization is responsible for instructing employees to request competent authorities to review, compare, adjust electronic data and submit the application directly according to regulations".

Accordingly, to receive unemployment benefits, Ms. Thuan is requested to contact the Employment Service Center under the Department of Home Affairs in the locality where she needs to receive unemployment benefits (regardless of where she previously worked) for guidance, reception and handling of documents according to regulations.

The Social Insurance Agency will pay unemployment benefits to employees after receiving the Unemployment Insurance Decision issued by the Department of Home Affairs and transferring it to the Social Insurance Agency.
