Unemployment benefits from 2026: 4 latest conditions
The Social Insurance Agency has just responded and provided information on the conditions for receiving unemployment benefits from 2026.
Sending a question to the Social Insurance agency, reader T.X.M said: "I participate in social insurance until September 2025, which is 1 year and 9 months. May I ask, am I eligible for unemployment benefits? How are benefits enjoyed? Where to submit the application? ".
Regarding this issue, Bac Ninh Social Insurance responded as follows:
Pursuant to Article 38 of the 2025 Law on Employment, employees specified in Clause 1, Article 31 of this Law who are paying unemployment insurance are entitled to unemployment benefits when meeting the following conditions:
"a) Resignation of labor contract, employment contract or termination of employment according to the provisions of law without falling into one of the cases where the employee unilaterally terminates the labor contract illegally according to the provisions of the Labor Code or the employee quits work when eligible for pension.
b) Having paid unemployment insurance for 12 months or more within 24 months before the termination of the labor contract, employment contract or termination of employment as prescribed by law.
In case the employee works under a labor contract with a term of 01 month to less than 12 months, he/she must pay for 12 months or more within 36 months before terminating the labor contract.
c) Having submitted a complete application for unemployment benefits within 03 months from the date of termination of the labor contract, employment contract or termination of employment.
d) Within 10 working days from the date of submitting a complete application for unemployment benefits, employees who are not employed and are subject to compulsory social insurance as prescribed in the Law on Social Insurance or perform military service, military service, membership in the People's Public Security, regular militia or study for more than 12 months or comply with the decision to apply the measure of being sent to compulsory education institutions, compulsory drug rehabilitation facilities or being detained, serving a prison sentence or settling abroad or dying".
Benefit level, duration of benefits, time of benefits and documents, procedures for receiving unemployment benefits.
Pursuant to Article 39 of the 2025 Law on Employment, the benefit level, benefit period, benefit time and documents, procedures for receiving unemployment benefits are as follows:
"1. The monthly unemployment benefit is equal to 60% of the average monthly salary for unemployment insurance contributions of the 06 most recent months of unemployment insurance contributions before the termination of labor contracts, employment contracts or termination of employment, but not exceeding 05 times the minimum monthly salary by region announced by the Government applied in the last month of unemployment insurance contributions.
2. The unemployment benefit period is calculated based on the number of months of unemployment insurance contributions, for every 12 months to 36 months of contributions, 03 months of unemployment benefits will be received, then for every additional 12 months of contributions, 01 month of unemployment benefits will be received, but the maximum unemployment benefit period is 12 months.
3. The time to receive unemployment benefits is the 11th working day from the date of submitting a complete application for unemployment benefits.
4. Employees who are receiving unemployment benefits are entitled to health insurance benefits according to the provisions of the law on health insurance, including the period of temporary suspension of unemployment benefits according to the provisions of Clause 2, Article 41 of this Law. People receiving unemployment benefits are covered by the social insurance agency under the Unemployment Insurance Fund".
