New regulations exclusively for male teachers from April 22, 2025
Below are new regulations on working time and regime for male teachers effective from April 22, 2025.
One of the notable new points stipulated in Circular 05/2025/TT-BGDDT stipulates the working regime for general education and university reserve teachers, which is male teachers on maternity leave who do not have to teach compensation.
Accordingly, Clause 3, Article 6 of Circular 05/2025/TT-BGDDT stipulates the maternity leave regime for male teachers when their wives give birth from April 22, 2025 as follows:
In case a male teacher is entitled to maternity leave when his wife gives birth according to the provisions of the Law on Social Insurance, during the leave, the male teacher is allowed to teach at the prescribed teaching period and does not have to teach compensation. In case the maternity leave when the male teacher's wife gives birth coincides with the summer vacation, there will be no compensatory leave.
Thus, from April 22, 2025, during the maternity leave when the wife gives birth according to regulations, male teachers are still allowed to teach according to the teaching period norm and do not have to teach compensation.
Notably, in case the maternity leave when the male teacher's wife gives birth coincides with the summer vacation, there will be no compensatory leave.
According to Clause 2, Article 34 of the Law on Social Insurance 2014, maternity leave for male employees who are paying social insurance and are entitled to maternity benefits when their wife gives birth and has 5 working days off.
In case the wife gives birth and has to have surgery, gives birth to a child under 32 weeks old, and has 7 working days off.
In case the couple has 10 working days off. If they have 3 children or more, each additional child will have 3 more working days off.
In case the wife has twin or more and needs surgery: 14 working days off.
The period of maternity leave is calculated within the first 30 days from the date the wife gives birth.
Currently, according to Circular 28/2009/TT-BGDDT, male teachers who are paying social insurance and have a wife giving birth are entitled to maternity leave for 5 - 14 working days depending on whether the wife gives birth naturally or gives birth by cesarean section, gives birth by twin, gives birth by father, ... but are not allowed to reduce teaching hours according to regulations.
Accordingly, Circular 05/2025/TT-BGDDT takes effect from April 22, 2025.
