The Ministry of Home Affairs informs about the rankings and salaries of Chairmen of Commune People's Committees
The Ministry of Home Affairs said that the salary arrangement for commune-level civil servants is implemented consistently according to the general salary regime for cadres and civil servants.
In Official Letter 11185 sent to the Department of Home Affairs of Khanh Hoa province, the Ministry of Home Affairs has provided specific instructions on classifying salaries as senior experts for Chairmen of Commune People's Committees.
Previously, the Department of Home Affairs of Khanh Hoa province said that, based on Point b, Clause 2, Article 70 of Decree No. 170/2025 dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, there are regulations: The rank of main specialist or equivalent in cases of being appointed to the position, title of Deputy Director and equivalent under the Ministry, ministerial-level agency, government agency, or organization established by the Government or the Prime Minister but not a public service unit (applicable to cases identified as civil servants and agencies, organizations assigned to management authority); Deputy Director of the Department and equivalent under the Provincial People's Committee; Chairman of the People's Committee at the commune level.
The Department of Home Affairs of Khanh Hoa province questions whether for cases holding the position of Chairman of the People's Committee at the commune level who are currently receiving a specialist salary, their salary will be converted to the main specialist salary as prescribed above or not?
In case of being classified, the Department should request the Ministry of Home Affairs to study and have specific instructions so that the locality has a basis for implementation and synchronous implementation.
At the same time, in the case of holding the position of Chairman of the People's Council at the commune level (the same title in group 6 as the position of Chairman of the People's Committee at the commune level according to Regulation No. 368 dated September 8, 2025 of the Politburo), currently receiving the salary of a specialist, will the salary be transferred to the main specialist position as the position of Chairman of the People's Committee at the commune level?
Regarding the above content, the Ministry of Home Affairs has the following opinion: Pursuant to the Law on Cadres and Civil Servants and Clause 3, Article 71 of Decree No. 170/2025 dated June 30, 2025 of the Government stipulates: "Remove relevant regulations on commune-level civil servants in Decree No. 33/2023 dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups".
Accordingly, the salary arrangement for commune-level civil servants is implemented consistently according to the general salary regime applied to cadres and civil servants according to Government regulations.
Pursuant to the provisions of Point b, Clause 2, Article 24 of the Law on Cadres and Civil Servants 2025 and Point a and Point b, Clause 2, Article 70 of Decree No. 170/2025, the Ministry of Home Affairs proposes that the Department of Home Affairs of Khanh Hoa province advise competent authorities to issue a decision to rank civil servants from specialists to main specialists when appointed to the position and title of Chairman of the People's Committee at the commune level and equivalent.
Decree No. 170/2025 does not stipulate the order, procedures, and records for the above cases as before. The salary arrangement is implemented according to the provisions of Circular 02/2017.
