Quang Ninh Procuracy Department handles, resolves, and recovers more than 130 billion VND of tax debt and social insurance debt

From the encroached sea surface to the dismantled walls

On July 27, 2026, a lawsuit decision was issued by the People's Procuracy of Region 4, under the People's Procuracy of Quang Ninh City, starting a civil service case in Dong Ngu commune.

Mr. P.B - residing in Dong Ngu commune - uses more than 8.6ha of sea surface for oyster farming but has not been licensed by a competent State agency.

Mr. P.B also used non-standard foam buoys in oyster farming, which poses a risk of marine environmental pollution.

The People's Procuracy of Region 4 requested Mr. P.B to stop the violation and implement remedial measures. However, after the prescribed deadline, the remediation has not been fully implemented.

The People's Procuracy of Region 4 continued to propose that the People's Committee of Dong Ngu commune initiate a lawsuit to protect public interests. However, after the deadline, the locality has not implemented it, so the People's Procuracy of Region 4 decided to initiate a lawsuit, requesting the Court to force Mr. P.B to stop illegal oyster farming, dismantle the construction, return the sea surface and overcome the risk of environmental pollution.

Previously, in April 2026, the People's Procuracy of Region 1, the People's Procuracy of Quang Ninh City determined that Mr. D. H. T and Ms. B.T. H, both residing in Bai Chay ward, had a project located in the road safety corridor of Bai Chay bridge.

After the deadline, the violation must be terminated, the construction must be demolished and the ground must be returned, but the two individuals did not comply, so on July 15, the People's Procuracy of Region 1 decided to sue, requesting the Court to force the defendants to demolish the fence and return the land belonging to the road safety corridor to Bai Chay Ward People's Committee for management.

But before the opening of the trial, another development occurred: The defendants voluntarily demolished the project and returned the site to the local management.

Therefore, the People's Procuracy of Region 1 withdrew the lawsuit request and the case closed not by a court ruling, but by the fact that the project had been dismantled and the ground was returned.

Hundreds of billions of VND return to the budget

If in the above cases, public interest is expressed through the sea surface, land and transport infrastructure, then in a case tried on September 3, 2026, that benefit is measured by tax payable to the State budget.

The People's Procuracy of Region 3, under the People's Procuracy of Quang Ninh City, has sued Binh Quyen Trading and Service Co., Ltd. for tax debt.

After receiving documents provided by the Tax authority, the People's Procuracy of Region 3 determined that the case was related to protecting public interests. The enterprise was requested to stop the violation and remedy the consequences, but when the deadline expired, it still did not comply.

The People's Procuracy of Region 3 then filed a lawsuit, requesting the Court to force the enterprise to fully fulfill its tax obligations.

At the trial, the People's Court of Region 3, under the People's Court of Quang Ninh City, accepted all lawsuit requests, ordering Binh Quyen Trading and Service Co., Ltd. to immediately and fully pay the remaining tax arrears and late payment interest up to the time of trial, totaling more than 589 million VND.

This is just one case in the overall result of the pilot project of the People's Procuracy initiating a civil case to protect public interests and vulnerable groups in Quang Ninh.

Quang Ninh is one of 6 localities nationwide assigned by the National Assembly to pilot this model from the beginning of 2026. To date, the People's Procuracy at two levels of Quang Ninh has received and resolved more than 276 cases related to public interests; recovered and paid to the State budget more than 130 billion VND of tax debt and social insurance debt, and at the same time recovered more than 165,000m2 of land.

Notably, many cases do not need to go to the stage of suing. After receiving the decision requesting termination of the violation, remedy of consequences and being explained about responsibility, many businesses have voluntarily fulfilled their obligations.

Typically, TL Trading Co., Ltd. immediately fulfilled its tax payment obligation of 44.5 billion VND. TN 508 Joint Stock Company fulfilled its tax payment obligation of 29.7 billion VND. A large enterprise also committed to pay a tax debt of up to hundreds of billions of VND after working with the People's Procuracy of Quang Ninh City.

These figures show the effectiveness of the "petition first, lawsuit later" approach: The weight is not only in one lawsuit decision, but also in the ability to proactively remedy violations before having to go to court.
