Procedures and dossiers requesting dismissal of People's Judges

The Chief Justice of the Supreme People's Court has just issued Circular No. 02/2026/TT-TANDTC of the Supreme People's Court stipulating procedures and dossiers for proposing appointment, reappointment, consideration of promotion, transfer, assignment, dismissal, and removal of Judges of the People's Court. The Circular takes effect from January 15, 2026.

In which, Article 19 stipulates the Procedures and dossiers for proposing dismissal of Judges of People's Courts.

According to regulations, the procedure for requesting the dismissal of Judges of People's Courts is carried out in the following order:

Based on the provisions of Clause 2, Article 108 of the Law on Organization of People's Courts, the unit advising on personnel organization work shall compile documents related to the violations of Judges of People's Courts, report to the Standing Committee of the Party Committee of the Supreme People's Court, and the Party Committee of the People's Courts at the provincial level for comments;

Based on the opinions of the Standing Committee of the Party Committee of the Supreme People's Court, the Party Committee of the Provincial People's Court, the advisory unit on personnel organization work requests the Judge of the People's Court to review and explain the violations and carry out procedures to submit to the Chief Justice of the Supreme People's Court, the Chief Justice of the Provincial People's Court to establish a Disciplinary Council according to the provisions of law to consider the violations of the Judge of the People's Court.

Based on the conclusion of the Disciplinary Council, the Department of Organization - Personnel of the Supreme People's Court, the Chief Justice of the Provincial People's Court shall submit to the Chief Justice of the Supreme People's Court, the National Judge Selection and Supervision Council to consider the dismissal of Judges of the People's Court.

According to the proposal of the National Judge Selection and Supervision Council, the Chief Justice of the Supreme People's Court submitted to the President to dismiss the Judge of the People's Court.

Dossier requesting dismissal of Judge of the People's Court includes:

Submission proposing dismissal of Judges of the People's Court;

Self-criticism report on the violations of the People's Court Judge. In case the People's Court Judge does not conduct self-criticism, there must be a report from the Head of the unit, the Chief Justice of the People's Court where the People's Court Judge works on the violations of the People's Court Judge;

Minutes of the disciplinary meeting for Judges of the People's Court with violations of the Disciplinary Council;

Documents proving the violation of the Judge of the People's Court and other relevant documents (if any);

Disciplinary decisions of agencies and competent persons (if any).
