The National Assembly passed the Trade Union Law (amended)
On the morning of November 27, the National Assembly passed the Trade Union Law (amended), in which the regulation on 2% union funds continues to be maintained.
This morning (November 27), with the majority of delegates in favor, the National Assembly passed the Trade Union Law (amended).
The draft Law on Trade Unions (amended) was passed with 6 chapters and 37 articles, an increase of 4 articles compared to the current Law.
Compared to the current Law, the draft Law on Trade Unions (amended) has some basic new points as follows:
Vietnamese workers working without labor relations in Vietnam have the right to establish, join and operate trade unions. Supplement the right to join and operate trade unions at grassroots trade unions (without the right to establish and not become trade union officials) of foreign workers working in Vietnam. Supplementing the right to join the Vietnam Trade Union of workers' organizations at enterprises;
Clearly identify and define Vietnam Trade Union with Vietnam General Confederation of Labor, clearly defining 4 levels of trade unions. At the same time, it affirmed that Vietnam Trade Union is the only organization representing workers at the national level in labor relations;
Supplementing the right of the Trade Union to supervise and provide social criticism;
Supplement cases of exemption, reduction, and suspension of trade union fee payment and the Government shall regulate these cases after reaching an agreement with the Vietnam General Confederation of Labor;
Continue to maintain the trade union fee contribution rate at 2%, along with amending and supplementing regulations to clarify the principles of management and use of trade union finances; amending and supplementing the expenditure tasks of trade union finances; supplementing regulations on the Vietnam General Confederation of Labor to decentralize the collection and distribution of trade union funds; the Vietnam General Confederation of Labor to issue standards, norms, spending regimes and management and use of trade union finances after reaching agreement with the Government;
Supplement the responsibility of the Vietnam General Confederation of Labor to periodically report to the National Assembly every two years on the situation of collection, expenditure and management and use of trade union finances. At the same time, supplement the responsibility of the State Audit, every two years, conduct audits of the management and use of trade union finances and conduct surprise audits as required by the National Assembly and the National Assembly Standing Committee.
The Trade Union Law (amended) takes effect from July 1, 2025.
