Article 21, Decree 337/2025/ND-CP on Electronic Labor Contracts (effective from January 1, 2026), stipulates the responsibilities of eContract Providers as follows:
1. Sending an electronic labor contract with an ID to employees and employers in the form of a data message via an appropriate electronic means according to the service provision agreement.
2. Establish a stable and safe technical connection channel with the Electronic Labor Contract Platform, ensuring the ability to transmit data accurately, promptly and securely.
3. Publicly announce the method of operation and service quality on the official electronic information page of the eContract Provider, including: service registration process, form, related costs and service provision conditions.
4. Ensure continuous, secure and complete connection of electronic labor contract data; necessary conditions for signing electronic labor contracts and conducting transactions as required by relevant parties in signing and implementing electronic labor contracts.
5. Providing tools for employers to digitize and change the form between paper labor contracts and electronic labor contracts; tools to report labor use situations according to legal regulations.
6. Fully implement the reporting regime on the implementation of eContract provision activities; on the situation of electronic labor contract transactions on eContract according to the regulations of the Ministry of Home Affairs.
7. store electronic labor contract data in accordance with the provisions of law on archiving.
8. Develop and maintain technical plans, organization, personnel and professional processes to certify electronic labor contracts.
9. In case the eContract Supplier ceases operations, all electronic labor contract data must be transferred to the Electronic Labor Contract Platform according to the instructions of the Ministry of Home Affairs.
Thus, eContract is responsible as above for electronic labor contracts.
