Conditions for signing electronic labor contracts through eContract

The Lao Dong Newspaper Legal Consulting Office replied:
Clause 1, Article 6, Decree 337/2025/ND-CP on Electronic Labor Contracts (effective from January 1, 2026), stipulates that the signing of electronic labor contracts is carried out through eContract to ensure the following conditions:
a) Using digital signature software, checking digital signatures to meet the requirements of the law on electronic transactions.
b) Have security measures to ensure the safety of customer information and electronic labor contract data; have technical plans to ensure the maintenance and repair of electronic contract certification activities when incidents occur.
c) Have a storage plan, ensuring data integrity of electronic documents; ensure the ability to look up electronic labor contracts that have been signed on eContract.
d) Have the function of ensuring the correct identification of the subject and performing identity authentication according to the provisions of law on electronic identification and authentication of employees and employers.
d) Have technical measures to confirm that the identified organization or individual has agreed with the contents of the labor contract.
e) Have the function of authenticating electronic labor contracts according to the provisions of law on electronic transactions to authenticate electronic labor contracts before sending electronic labor contracts to the Electronic Labor Contract Platform for ID attachment.
g) Having the function of converting the form between an electronic labor contract and a paper labor contract according to the provisions of the law on electronic transactions.
h) Providing an electronic transaction account in accordance with the conditions specified in Article 46 of the Law on Electronic Transactions.
i) Having the function of supporting employers in reporting on the situation of employment according to the provisions of labor law through the protocol and format prescribed by the Ministry of Home Affairs.
k) Having the function of synthesizing, statistics, periodic or ad hoc reporting for the management of electronic labor contracts.
l) Connecting via the standard application programming interface (API) with the Electronic Labor Contract Platform as prescribed by the Ministry of Home Affairs.
m) Ensure technical requirements for information security according to regulations on network information security law.
Thus, the signing of an electronic labor contract through eContract must meet the above conditions.
