From January 2026, employees can sign electronic labor contracts according to the provisions of Decree 337/2025/ND-CP.

The Government has just issued Decree 337/2025/ND-CP regulating electronic labor contracts (effective from January 1, 2026).

According to Article 5, Decree 337/2025/ND-CP, the Subjects participating in the Association and implementation of electronic labor contracts include: Employees and employers with the authority to sign labor contracts as prescribed in Article 18 of the Labor Code and eContract Providers to ensure the conditions specified in Clause 3, Article 6 of this Decree.

Also according to Decree 337/2025/ND-CP, Electronic labor contracts are labor contracts signed and established in the form of data messages according to the provisions of the law on labor and the law on electronic transactions, with legal value like a paper labor contract.

Clause 3, Article 6 of Decree 337/2025/ND-CP stipulates: eContract suppliers must ensure the following conditions:

a) Having eContract that meets the conditions in Clause 1 of this Article.

b) Having solutions and technologies to collect, check, compare, ensure correct matching between information on recognizing organizations, individuals, biometric data of legal representatives of organizations and individuals (which are biological factors and characteristics associated with legal representatives of organizations and individuals performing identification, difficult to forge, low coincidence rates such as fingers, faces, eyes, voices and other biometric factors) with corresponding biometric information and factors on the identification documents of legal representatives of organizations and individuals specified in Clause 2 of this Article and ensuring correct identification of subjects and authentication of identities according to the provisions of the law on identification and electronic authentication.

c) Having a trust service business license with a type of service permitted for business, which is the provision of data message authentication services according to the law on electronic transactions.

Thus, from January 1, 2026, employees can sign electronic labor contracts.
