8 responsibilities of businesses operating employment services

Article 23, Decree 352/2025/ND-CP detailing a number of articles of the Law on Employment on Employment Services (effective from January 1, 2026), stipulates the responsibilities of enterprises operating employment services as follows:
1. Publicly post a certified copy of the original License, work schedule, consulting service price, job introduction at the head office providing job services, business branch and contact information of the business including: Business name, head office address and branch, website (if any), email, contact phone number.
2. Within 20 working days from the date the employer announces the recruitment of employees, the enterprise is responsible for updating the results on the National Employment Exchange; monitoring the employment status of employees recommended by the enterprise for at least 01 month or during the implementation of labor contracts for cases of labor contracts under 01 month according to Form No. 04 of Appendix I issued with this Decree.
3. Establish, update, manage labor data to register for consultation, job introduction; employers register for labor recruitment and connect, share information and data according to the instructions of the Ministry of Home Affairs.
4. Ensure the safety and confidentiality of personal data, labor data, and job transaction data in accordance with the provisions of law; develop and implement preventive measures, detect, warn, and prevent fraud and scams in employment service activities.
5. Enterprises operating employment services by e-commerce are responsible for connecting, sharing, and synchronizing information and data on the National Employment Exchange.
6. Within 15 working days from the date of receipt of the document from the competent authority on not reissuing or not renewing or revoking the license, the enterprise is responsible for liquidating the employment service contracts it is performing; performing obligations and responsibilities in employment service activities for the agency, organization and individual according to the provisions of law.
7. Periodically every 6 months (before June 20) and annually (before December 20), report the results of employment service activities to competent authorities through the National Employment Exchange according to Form No. 02 of Appendix III issued with this Decree.
06 month periodic report: Data finalization period is calculated from December 15, the year before the reporting period to June 14 of the reporting period.
Annual periodic report: The data finalization period is calculated from December 15 of the year before the reporting period to December 14 of the reporting period.
8. Fully fulfill the responsibilities of enterprises operating employment services according to the provisions of this Decree.
Thus, from January 1, 2026, enterprises operating employment services will have the above responsibilities.
